- The purposes of the Districts include the following: water and wastewater service (both via IGA with Woodmoor Water and Sanitation District); street Improvements, transportation and safety protection; drainage; parks and recreation; mosquito control; fire protection; television relay and translation; covenant enforcement and design review; security services; and solid waste disposal. The initial inclusion area includes approximately 65 acres located at the southwest corner of the County Line Road and Interstate 25 interchange. The proposed Districts will help fund the design, construction, and ongoing operation of infrastructure and services to support residential development of the subject property which is concurrently proposed to be zoned to RM-12 and RS-6000 pursuant to the El Paso County Land Development Code and subdivided as depicted on the Monument Ridge East preliminary plan.

Staff discussed terminology in detail with the BoCC at the Monument Ridge East hearing. The definition of single-family attached from the Code is below. Single-family can be any combination of more than 1 dwelling unit on its own lot. Note that the definition even calls out “townhouse” or “row house”. As long as each individual unit is on an individual lot the condition is met. The definition does not allow any type of stacked unit. The code does not define a paired patio home. That would be one type of product permitted under the definition of single-family attached. BoCC Condition: "The preliminary Plan and Subsequent Final Plats are limited to a total of 37 Single-family detached dwellings and 303 Single Family Attached Dwelling on its own lot." Dwelling, Single-Family Attached — A structure containing more than 1 dwelling unit, each of which has primary ground floor access to the outside and are attached to each other by party walls without openings, where each dwelling unit is generally located on its own lot. The common or abutting wall shall be shared for at least 50% of the length of the side of the dwelling units. A single-family attached dwelling does not share common floor/ceilings with other dwelling units. A single-family attached dwelling is also sometimes called a townhouse or row house. Please update the LOI and Plan to clarify language and modify units to the Single-Family allowance per the Condition. This is not a multi-family development but a single-family attached development, with each home on its own lot. The LOI states" Anticipated development of 342 residential units, including 37 single family residential units with a value of $825,000 per unit and 305 duplex, tri-plex, and four-plex units with a value of $500,000-650,000 per unit in 2024 year dollars." |

Note: Staff has received a copy of a resolution from the Town opposing the densities contemplated in the proposed service plan. If the rezonings are not approved by the BOCC, then the service plan would need to be rewritten. Please provide documentation from the existing Misty Acres District that the district supports the removal of commercial and multifamily land from the existing district or that the Overlap is supported by the District if no exclusion is to occur. The Misty Acres Service plan relies on that area to construct Misty Acres Blvd in phase 3, and contributions to debt incurred. If exclusion is to occur, when is that court date anticipated? I note the following two issues, which are acknowledged in the draft Service Plan: 1. Because this application is running concurrently with the necessary Underlying Land Use Approvals, there is a risk that this application may be denied or approved with conditions preventing moving forward to election unless and until those Underlying Land Use Approvals are obtained and support the development description and assumptions based thereon contained in this application. See El Paso County Special District Policies Section III.I dated 11/1/22 adopted under Resolution No. 22-376. 2. As noted in the draft Service Plan, part of proposed District 3 overlaps the Misty Acres Metro District. Though not required, I recommend excluding the affected property excluded from the Misty Acres Metro District prior to hearing on this application and obtaining a written statement from the Misty Acres Metro District that they are unwilling or unable to provide service to this property. |
