CGS previously reviewed this site (located at 38.9743, -104.6728) in our comments dated September 15, 2022. Our previous comments have been addressed in “Soil, Geology, and Geologic Hazard Study – Addendum” (Entech Engineering, November 17, 2022). Entech has stated, “Additional site investigation will be conducted as concept/development plans and grading are prepared for the site. The mapped wetlands located on the site are non-jurisdictional and will likely be regraded during the site preparation. Additional investigation will be conducted across the site and within areas identified with the potential for shallow or seasonal shallow groundwater conditions. The scope of the investigation will be based on the proposed grading.” Entech has also previously recommended lot-specific soils and foundation investigations as well. As the project progresses, it will be prudent for the county to ensure the regional studies are done as recommended by the geotechnical engineer based on the proposed grading and development plans and that their recommended site-specific soils and foundation investigations are also conducted for individual structures.

Black Forest Land Use Committee

The Black Forest Land Use Committee recommends that the Poco Road lots be 2.5 acres to provide a more gradual reduction in density from the 5-20 acre lots on the north side of Poco Road. It has been consistent when moving out of the treed area with 5-acre lots to step down to 2.5-acre lots so this would be in keeping with that pattern. This would also be a more gradual transition from the Smith lot on the south side of Poco Rd.

In addition, the lots on the western boundary would provide a better transition if they were 1-acre lots. Again, this would be a more logical transition from the 2.5-acre and larger lots in Highland Park and adjoining developed areas.

Colorado Parks and Wildlife (CPW) has reviewed the plans for the Jaynes Property Sketch Plan in El Paso County, Colorado at the Southwest corner of Vollmer and Poco Road. CPW is familiar with the site. Based both on the location and type of action that has been taken CPW anticipates that the impacts to the wildlife resource from this project would be negligible.

Per the Code Chapter 7, "The review examines the feasibility of the division of land including review of the schematic design, ability to obtain water and sanitation, location of geologic hazards, identification of environmentally sensitive areas and wildlife habitat areas, source of required services, vehicular and pedestrian circulation, relationship to surrounding land uses, evaluation of wildfire hazards and conformance with the requirements of this Code and Master Plan. During this step, public hearings are held before the Planning Commission and the BoCC." Documents available for this review include “Soil, Geology, & Geologic Hazard Study, Entech, April 5, 2022”. The Colorado Geological Survey (CGS) agrees with Entech that the proposed lots (located at 38.9743, -104.6728) do not contain geologic hazards or unusual geotechnical constraints due to the geology that would preclude the proposed residential use and density.
We commend Entech for providing tabular and map data on the depth of bedrock and groundwater. This information can be transformed into elevation data to evaluate the potential impacts of these geologic constraints on preliminary grading and development plans. CGS recommends that Entech consider adding legends to the maps to clarify what the numbers represent.
Entech discusses shallow, seasonally shallow, and potentially seasonally shallow groundwater. Before final approval and as final plans are developed, it would be prudent for the County to require discussion and evaluation of the expected groundwater fluctuations at this location based on seasonal measurements. The extent of groundwater fluctuation expected for a typical year throughout the proposed development can determine the feasibility of basements or other inhabitable below-grade areas and where the recommended drain systems will be required. Seasonal (throughout a year) groundwater fluctuations may demonstrate areas with shallow groundwater impacts outside of the areas mapped by Entech for the sketch plan. This preliminary work is based on single groundwater data points taken in September. A systematic groundwater monitoring program (measurements throughout the Spring, Summer, and Fall) can determine the extent of shallow groundwater impacts in the areas mapped with this potential and the overall development. This data can be used to discuss groundwater fluctuations expected at this location as required by Code.
Entech states, p.17, “Individual investigations for building sites will be required prior to construction.” CGS recommends that this be added to the final plans as a requirement for approval. We also recommend additional investigation and evaluation of the fluctuations expected in shallow groundwater at this site before approval of final plans. All of Entech’s recommendations should be incorporated into the final plans.

The Black Forest Land Use Committee has reviewed the Jaynes property development proposal and recommends DENIAL. The proposal is a significant violation of the new county master plan.

On page 26 of the county master plan in the Large Lot – Residential section it says, “If central water and wastewater can be provided, then lots sized less than 2.5-acres could be allowed if, 1) the overall density is at least 2.5-acres/lot, 2) the design for development incorporates conservation of open space, and 3) it is compatible with the character of existing developed areas.”

The gross density of this proposal is over 3 lots PER ACRE, far above the 2.5-acres per lot specified in the master plan.

The single park of 11 acres is merely 7% of the total area. This park is directly next to a busy thoroughfare on two sides.

The compatibility to surrounding development is consistent only on the Vollmer Road side where it borders on Sterling Ranch. On the north side along Poco Road, the density of 1/2-acre lots is directly across the road from lots ranging from 5-20 acres. Along the west side adjoining Highland Park the ½ and ¼ acre lots are directly adjacent to lots ranging from 2.5 to 8 acres. The very small buffer of 50 feet is not nearly adequate for a transition this large.

The Land Use Committee recommends the following changes to the sketch plan:

1. Eliminate the 50-foot buffer in the north and west boundary.

2. Substitute the 50-foot buffer with one row of 5-acre lots on the north boundary and one row of 2.5-acre lots on the west side.

3. Despite violating the master plan, the Land Use Committee is willing to accept the larger density on the Vollmer Road side since it is compatible with the Sterling Ranch lots across the road.

The Land Use Committee recommends DENIAL of this sketch plan and the return of the sketch plan to the applicant for redesign.
