CDOT does not have any comments as to the creation of Metro District No.1 & 2. CDOT requests that all further access to the developments within the Metro District be gained from for Metro Dist. No.1 along Meadowbrook Pkwy and for Metro Dist. No. 2 along Marksheffel Rd. No Direct access shall be gained from SH24 or SH94 respectively. In the Service Plan under section 3.E.2: Sanitation (page 8), the plan indicates that Crossroads Metropolitan District would have the ability to charge tap fees. CMD assesses a sewer tap fee to offset the capital cost of treatment of the subject property’s wastewater. CMD would not allow a District within its limits to assess tap fees for service provided by CMD.

Throughout the document it is unclear whether the water and sewer mains will be public (CMD-owned) or private (Crossroads owned). Please make clear whether infrastructure will be transferred to CMD and if so roughly where the line of demarcation is expected to be on a preliminary utility plan.

On August 4, 2020 the Equity Group submitted a petition for inclusion into the Falcon Fire District of the second parcel of land within the boundaries of Crossroads Metropolitan District No. 2 (“District No. 2”). It is anticipated that the Board will approve this inclusion request. As such the Falcon Fire District has reviewed this request for the crossroads metropolitan district and has no objection or concerns with its formation. 8/10/2020 3:07:54 PM

The service plan uploaded with review 2 is dated April 2020 prior to the May 2020 plan that has extensive comments. I did not review the April 2020 service plan based on the fact that Nina provided comments on the May 2020 plan that appear not to have been addressed. Please see her comments from review 1.

Please review letter of intent and development summary review 2 comments and apply to the service plan. Please review Nina's review 1 service plan comment and address into service plan.

You may need to really get creative to show how the Service plan is meeting the mandatory approval criteria and discretionary criteria as of now, you are not there in my opinion. Review the Ranch ID196 staff report and incorporate the criteria components onto the service plan where appropriate.

Please recall the Grandview Reserve comments we discussed on phone and incorporate them to the service plan to avoid another review which will certainly eliminate a November election.

The City has expressed concerns that the plan identifies land within the City of Colorado Springs to be included on this service plan area. Please verify and clarify in the LOI that no land that has been annexed into the City is proposed to be included in the Districts.
Provide one map that depicts the boundary for District 1 and District 2; label those please, and provide acreage of each District on the map. If proposed you can add an area to show potential district no. x (?) inclusion area....

The City of Colorado Springs Planning Department specifically requests language in the service plan that this and all newly created unincorporated metropolitan districts be prohibited from including additional territory within the corporate limits of Colorado Springs, without express prior consent of the City. We'd also appreciate confirmation back that this language has been included.
