The request for pre-development site grading needs to be removed from the LOI as there is no overlot grading; road construction will require complete construction drawing submittals, permitting, and financial assurances upon final plat approval.

PUD Use Note: No outside storage of any vehicles or lawn and garden equipment or any other items that are unsightly and that may be viewed from any interior roadway, home, lot or common area. The way this is written, it could be interpreted to mean you must park your car in the garage at all times. If you are actually referencing other vehicles such as boats, RVs, or inoperable passenger vehicles, etc. be more specific. Do you mind if those are in the driveway or just not on the lawn area? These are not clear from the way this item is written. Further down on the page are standards for accessory structures that refer to the Code dimensional standards. For reference, the square footage of accessory structures in the Code is limited based on the size of the building footprint of the primary residential structure: When a lot or parcel is 2.5 acres or larger, an accessory structure can be up to two times the size of the building footprint of the principal residence. Take this into consideration when assessing whether you will require boats and RVs to be stored inside a structure. Advisory Comments: PUD Development Plan - The purpose of a PUD is customizable zoning, usually because the standards of a specific zoning district can not be accomplished due to site constraints. In many cases, developers choose to limit the restrictions on the face of development plans to the items that are specific to the project that would not be permitted by the Land Development Code. For example, in your case, the most similar compatible straight zoning district is the RR-5 but, due to the land area that is taken up by the ephemeral creek, it would be difficult to accomplish the 5 acre minimum lot size of that district. Items that are on the face of the development plan and/or in the development guidelines become enforceable by the County so if, for example, the HOA wanted to offer more flexibility than what is shown on the plan or in the guidelines, the HOA and the residents would be limited to exactly what is shown. Based on this explanation, I encourage you to think about how you want the PUD to function in the future. Do you want everything to go through both the County and the HOA in regards to approvals for the PUD or do you prefer to break it up where the County deals with some of the issues and the HOA handles the rest? I have made some suggested rewording of various requirements on the PUD plan. I am hopeful some of the redlines on the PUD plan will allow us to work together to make sure the regulations are enforceable and the process is clear for those developing within the PUD so you can accomplish your development goals. 10/7/2020 10:30:41 PM

Colorado Geological Survey

The Colorado Geological Survey (CGS) previously reviewed this the property, and the current submittal is similar in scope to that reviewed in our letter dated 2.15.2005 (CGS Review No. EP-05-0039). CGS has no objection to the proposed project. Recommendations in the geology and soils reports should be followed. We repeat relevant portions of our previous suggestions for the current submittal:
1. Site-specific foundation investigation and testing should be conducted for each building prior to building to determine subsurface geologic characteristics that may impact foundation design (expansive soils, shallow groundwater, etc.).
2. Site-specific septic investigations, including percolation testing, should be done prior to building to determine design parameters, and whether special engineered systems are needed. Septic locations should remain out of drainage swales.
3. Minimal ground disturbance and best management practices during construction should take place to minimize erosion. Prompt reseeding should follow construction to re-establish ground cover and reduce noxious weed growth.
4. Building sites should be located in areas where building and septic footprints will not encroach on the natural drainage swales or drainage easements.

1. Since the access to the existing home is being added and there will be no access to Shoup Road the address to 7360 Shoup Road will need an address change. See the link for all the information Enumerations will need to complete the address change.
