RMG has addressed the comments and recommendations from our review (dated 11.24.20). We commend their thorough response both in the Response to CGS Comments, River Bend Crossing / Avatar, dated December 29, 2020 and the Geology and Soils Report, revised December 29, 2020.
CGS has no objection to approval of the preliminary development plans provided they are updated to reflect RMG’s and Catamount Engineering’s analysis and recommendations as detailed below, and all their recommendations are strictly adhered to. We recommend that:
• the lots where basements should be avoided are listed on the plans as detailed by RMG (Response letter, p.2);
• it be clarified on the plans that the 35’ setback line shown along the western property boundary conforms to the “influence zone” or 3:1 setback discussed by RMG (Response letter, p.3); and,
• it be shown on the plans where the Channel Bank Stabilization is expected (Catamount Engineering, Channel Bank Stabilization, Preliminary/Final Drainage Report for Riverbend Crossing, Filing No. 1 and 2 dated September 2018, p.11).

In addition, the Geology and Soils report and its date (December 29, 2020) should be listed on the plans under the heading GEOLOGICAL HAZARD.

We look forward to reviewing updated plans and plat prior to final project approval.

CGS recommends that the county require additional analysis regarding:
• Locations of expansive and/or collapsible soils;
• Shallow groundwater and seasonal variations of groundwater levels with regard to feasibility of basements and other below grade construction;
• Scour potential of erosive flows along fountain creek and potential need for scour protection;
• Analysis of stability of steep slopes;
o adjacent to Fountain Creek;
o along the slope break between the commercial and residential developments;
o along the western property boundary;
o and anywhere significant topographic changes occur;
• Locations of fill and/or debris (if any); and,
• RMG recommends removal and replacement of soft soils prior to foundation construction: We concur with this and would add that there may be collapse potential beneath foundation level. Even with structural fill, soft soils below foundation level may be prone to collapse. We recommend that along with evaluation for soil collapse or consolidation the soft soils beneath foundation levels also be evaluated for collapse potential.
• A detailed geology and geologic hazard map be prepared at the same scale as the site plans.
The feasibility of the preliminary plan has not been demonstrated due to incomplete analysis of existing geologic hazards. Mitigation of these conditions still needs to be fully addressed. As a condition of approval of the preliminary plan CGS recommends a new soils and geology report be completed that analyzes, discusses and provides mitigation recommendations for all geologic hazards and constraints identified within the site. CGS looks forward to reviewing the new soils and geology report prior to approval of development plans and final plat.

CGS has provided and repeated review comments for this project on 1.24.19, 10.18.19, 3.7.20 and now on 9.22.20. Our previous comments have not been addressed and are again repeated here. We do not recommend approval of this project until these comments are addressed.
Per El Paso County Land-use Code 8.4.9 (A) (1) “All sketch plans and preliminary plans submitted for review shall be accompanied by geology and soils report (sic).”
The submitted Preliminary Plan by Land Patterns, Inc., includes a Geologic Hazard Statement: “This property is subject to the findings summary and conclusions of the Geotechnical Report prepared by RMG – Rocky Mountain Group, Dated April 2, 2018.” This geotechnical report provides useful engineering details for the project but is not a geologic hazard report and does not meet the criteria for a geologic hazard report required to support a preliminary plan.
CGS recommends that the County require a geologic hazard report conforming to the Land Use Code and El Paso Counties Engineering Criteria manual prior to approval of the preliminary plan. The report should follow the guidelines of the counties land use documents and at a minimum identify and discuss the geologic hazards and constraints that impact or potentially impact the site. This discussion should include mitigation concepts for these geologic conditions. Additionally, a site geologic map, compiled at the same scale as the preliminary plan, should map these same geologic conditions discussed in the geologic hazard report.

CDWR noted in their letter dated 1/7/19 (and as reaffirmed on 10/10/19 and 2/18/20) that the District's letter of 12/11/18 doesn't commit to the total water demand of 118 acre-feet requested in the proposal. An updated District letter committing to the full water demand required for the development is necessary before the County Attorney's Office will be able to provide water findings for the subdivision.

Regarding a request for approval of a preliminary plan for Riverbend Crossing, Enumerations has the following comments:

1. Per Regional Building Code, section RBC312.8 addresses must appear on plats. Submit a 100 scale copy of the plat to our office for addressing. Place an (xxxx) on all lots and tracts which will require an address, in the location the address will be needed. Once addressing is completed, the addresses will be returned so that they may be placed on the mylar prior to recording.
2. For addressing purposes, Tract B, between lots 42 and 43 will be considered the boundary between Tak Dr. and Magon Way. A street sign indicating this separation should be placed in this location.

Floodplain has the following comments:

1. New FEMA FIRM panels recently became effective for El Paso County. The floodplain statement must be updated to reflect the new information: Map numbers 08041C0763G and 08041C0951G, both with effective dates of December 7, 2018.
2. Our current floodplain overlay shows floodplain in the approximate area of Lots 19-21 while the preliminary plan drawing does not. Contact Floodplain Administrator Keith Curtis (Keith@pprbd.org, 719-327-2898) to discuss.
