1 The El Paso County Conservation District has reviewed this project and we would like to make the following recommendations:

1) Erosion Control

We are unsure from the plan on how much of the total property will be used for the proposed purpose of the contractor's yard. So we make the following recommendations in relation to all areas planned on the site for that use.

A) Due to the size of area that the mapped site shows, we see there is likelihood for erosion from both wind and heavy rain events, which can affect both neighbors and potentially affect the portion of the Black Squirrel Creek watershed, which flows on the property directly west of this property and is visible via Google maps. However, we understand that since this is likely to be an area that experiences heavy traffic through the proposed use, planting vegetative cover (like we typically suggest) will not be the proper course of action to mitigate this concern. As a substitute practice to mitigate this risk, we would like to see this applicant apply a rocky mulch such as pea gravel, 1/2" to 1" crushed rock/concrete, or a similar material to a depth of 1-2" deep on all areas within the proposed yard where the proposed use is to leave bare ground. Doing this will substantially reduce the risk of wind and water caused erosion concerns we have.

B) If there are disturbed areas that will not be impacted by traffic/parking, these should be mulched and revegetated within 45 days of disturbance using plant/grass species native and/or naturalized to El Paso County. These seeded areas should be mulched after seeding with weed-free hay or straw mulch at approximately 5,000 lbs per acre due to the exposed site and its proneness to wind erosion

C) Consideration of using of the El Paso County Conservation District’s Native Shotgun Mix (available at EPCCD.org) for reseeding, which is well suited to soils present on this site and is comprised of 100% native and naturalized grass species.



If these measures are added to the project's plan, then the El Paso County Conservation District will be content with the applicant's commitment to soil conservation, watershed and wildlife protection, and safety of the community downstream.

1 El Paso County Parks Department. The 2022 El Paso County Parks Master Plan shows no impacts by this project to existing or proposed parks, trails, or open space. As such, no trail easement or parkland dedications will be necessary as this project moves forward. 1 The proposal, as described within the Letter of Intent of the IFC. However, the submitted site exhibit only highlights the general area of use. Prior to approval, an updated site plan shall be provided clearly identifying:
1. The designated Fire Apparatus Access Road (FAAR) serving the equipment storage area.
2. Road width (20' minimum), surface type w/ compaction rating (75,000 gross), vertical clearance (13' 6" minimum), and turning radii sufficient (25' interior; 50' exterior).
3. All gate locations, if applicable
4. Gate specifications, including width (16' minimum), method of operation (swing vs. electronic), and provisions for emergency responder access (e.g., Knox Lock or Know Switch).

The Peyton Fire Department supports and approves the requested Variance of Use from a fire code perspective. However, prior to approval of any formal site plan or development permit, a detailed plan identifying the FAAR, gate locations, and emergency responder access provisions as outlined above shall be submitted for review and approval.

1 2/24/26. MVEA has no objection to the proposed Variance of Use and will work with the developer on the design of the electric service and to acquire any needed utility easements. MVEA has existing electric and/or broadband facilities near and within this parcel of land. If there is any damage, removal or relocation of facilities it will be at the expense of the applicant.
