1 Review 1: PCD Planning Division has no comments at this time. Please note that this Development Agreement and associated documentation pertain to the public improvements for Filing 1 only. Future filings will be required to submit Final Plat applications prior to commencement of construction of those filings or creation of any lots beyond those recorded in Filing No. 1. 1 Requested edits to DMA attached.
I also have questions about the HOA as the maintenance entity for the pond. I see that it has already been formed. Do the covenants contemplate this agreement? If not, will the HOA support amending the covenants to assume this responsibility and provide a funding mechanism for it? Finally, since many lots have been sold, I am concerned that in the event the HOA fails, and the individual lot owners are collectively responsible for maintenance per the DMA, it will be difficult to enforce that responsibility against lots not currently under developer ownership, since this DMA will not have been recorded against them. Thoughts?
