The available referral documents include the PUD Development Plan (HR Green Development, LLC, April 17, 2025), the Letter of Intent (HR Green Development, LLC, February 19, 2025), the Soil and Geology Study (Entech Engineering, Inc., January 24, 2025), and other relevant documents. We understand that the applicant desires a major amendment to the approved 2016 PUD preliminary plan for the proposed Filing Nos. 6 and 7, which involves the development of 106 single-family residential units (47 lots within Filing No. 6 and 59 lots within Filing No. 7). The amendment also includes improvements to roadways and the proposed construction of detention ponds. Entech identifies areas that will impose geologic constraints, including (page 1) “seasonal and potentially seasonal shallow groundwater areas, drainage areas, areas of ponded water, floodplain, erosion, artificial fill, expansive soils, and areas of downslope creep.” Entech’s characterization of the geologic hazards and constraints associated with the site is valid. Provided Entech’s recommendations are adhered to, CGS has no objection to approval of the PUD Development plan amendment as proposed. We offer the following comments: 1. Entech did not encounter groundwater in their test borings or pits within Filings 6 or 7. Even so, groundwater levels tend to fluctuate, and perched water is likely to collect above clayey, less permeable soil layers on top of the bedrock surface. If basements are being considered, CGS recommends the county require groundwater monitoring/observation holes to obtain groundwater data to verify that proposed floor levels are at least three feet (preferably 5 feet) above maximum anticipated groundwater levels and maintained year-round. To be effective, however, this monitoring should include measurements/observations through fall, winter, and spring and not merely during site-specific building investigations. 2. CGS agrees with Entech (page 10), “Subsurface perimeter drains are recommended for any usable below grade areas including crawlspaces. Should groundwater be encountered at within 3 feet of foundation grade additional drains that could include but not limited to interceptor drains, underslab drain (capillary break), and overexcavation drains may be needed.” An underdrain system should be allowed ONLY if it can gravity discharge to a daylight outfall or is connected to an existing underdrain system that gravity discharges to a daylight outfall. Individual foundation perimeter drains are intended to handle small amounts of intermittent, perched water and may NOT be used to mitigate persistent shallow groundwater conditions. 3. Multiple drainages exist within the project area that are designated as existing wetlands per the National Wetlands Inventory (U.S. Fish and Wildlife Service, National Standards and Support Team, wetlands_team@fws.gov). The Black Forest Land Use Committee commends the applicant for returning to the original plan for lots 2.5-acres and larger. This will maintain the Black Forest as a rural, residential community that has larger lots and is preserving natural trees and wildlife habitat. The Committee recommends approval. P.S. On page 2 of the LOI, second to the last line, the reference to 2.0 DU/AC must be a misprint of some kind because it doesn't match the rest of the plan. |

Academy District 20 is in receipt of File #PUDSP252 for approval of the Flying Horse North PUD/SP Amendment (Major/Filings 6-7). The District is requesting fees in lieu of land dedication per the existing County Code for all residential units within this development. The District is experiencing ongoing residential development. The District gained approximately 12,000 new residential units between 2018 and 2024 which included 5,278 Single Family, 1,156 Single Family Attached, and 5,576 Apartments as reported to the District by local developers. During that same timeframe, the District only experienced a total membership increase of 138 students. This information is updated annually in October. A drop in the birth rate plus the significant increase in the cost of housing has slowed student growth in the District. The District is able to serve each student who is a resident of District 20.
