1 The El Paso County Conservation District has reviewed this and we have the following comments:

1) Erosion controls/Revegetation plans

We did not see any documents that went over an erosion control or revegetation/landscape plan during and post construction of the proposed building. As such, EPCCD would like to see the following recommendations followed during and after construction:

A) Disturbed areas not being built on should be mulched and revegetated within 45 days of disturbance using plant/grass species native and/or naturalized to El Paso County.

B) Disturbed areas be either: mulched after seeding with weed-free hay or straw mulch at approximately 5,000 lbs per acre due to the exposed site and its proneness to wind erosion; Or areas that are not suitable for revegetation such as driveways, parking areas (if not going to be paved), or safety areas around buildings should have a 1-2" thick layer of crushed rock, road base, or gravel to assist in preventing having exposed soil that would be prone to wind/runoff erosion concerns.

C) Due to the presence of a natural drainage and active pond along the edge of the property, there should be some form of silt fence around the perimeter of the construction site until completed to help prevent loose dirt from eroding into this drainage and negatively effecting the watershed.

D) For areas being replanted with natural grass, consider using the El Paso County Conservation District’s Native Shotgun Mix (available at EPCCD.org) for reseeding, which is well suited to soils present on this site and is comprised of 100% native and naturalized grass species.


2) Watershed/Riparian Concerns

Looking at the property on several different maps, the property has a very obvious and active pond and riparian area on the immediately adjacent property to the south, and those riparian areas extend into the applicant's property. The applicant's site map is very basic and does not show these lower riparian areas and drainages across the property that would not be suitable building locations.

A) Applicant will need to show they are not altering these drainages or riparian areas, which is important for watershed health and function.

B) Applicant is going to need to show their build site for the ADU is not within unsuitable spots of the property where flooding of the spot is likely in high rainfall events, based on county and PPRBD requirements.


If these measures are added to the project's plan, then the El Paso County Conservation District will be content with the applicant's commitment to soil conservation, watershed protection, and protection of the surrounding community.

1 In reviewing this application, please note that the well permit has not gotten a change in permit for 2 homes, as it reads now it only allows for one home. The district does allow 2 homes on one well, however, it should be stated that both homes will have to share the acre-feet amount and they are only allowed 13,000 sq. feet of lawn and garden irrigation. They will also have to share that with both homes. The well is supposed to be metered and meter readings sent into the Upper Black Squirrel Creek GWMD monthly and they have not done that. Tiboria Estates had a water supply plan and I am unsure if it allows for 2 homes on a property, that may be something you need to check with the State about. 5/12/2026 2:04:16 PM

1 On 05/06/2026, PCD mailed "Notice of Administrative Determination" letters for AL2610 to surrounding property owners within a 500-foot range (11 addresses). The potential date an administrative decision can be made is 05/20/2026. Copies of the notice, mailing labels, and selected range have been uploaded to the EDARP file. 1 1. Would the new home have a full kitchen with a 200 volt stove? Accessory Living Quarters - Lodging, which may include a kitchen, that is accessory to the principal dwelling which may be occupied only by occasional, non-paying guests of the family residing in the principal dwelling. Accessory living quarters are not considered dwelling units. The term does not include farm/ranch residence, caretakers quarters, or an additional dwelling.
The size of the stove will determine the above and if another address will be assigned or not.

2. Please show the driveway to the new home. When submitting plans to Regional Building Department for permit, please include legal description to the property, (found on the El Paso County Assessor's website), also label each address on the property next to each home.
