The Black Forest Land Use Committee commends the applicant for this filing which is in compliance with the original preliminary plan in most areas. This filing is also in conformance with filings 1 and 2 and will provide a more consistent development overall. We believe that returning to the minimum 2.5-acre lots or larger will result in a much more desirable community and will conform with the rural, residential flavor of the Black Forest. Rather than a small town with street lights, curbs and gutters, sidewalks and many more lawns and landscaping, the 2.5-acre and larger lots will more likely retain the country feel with less landscaping and more water-absorbing surface to contain rain and snow. The available referral documents include the PUD Development Plan (HR Green Development, LLC, September 16, 2024), Letter of Intent (HR Green Development, LLC, September 19, 2024), Soils and Geology Study (Entech Engineering, Inc., September 11, 2024), and other documents. Provided Entech’s recommendations are strictly adhered to, CGS has no concerns with Filing No. 4. We offer the following comments: 1. Note 6 on the PUD Development plan references the correct Entech report. Lots located within areas of geologic hazards/constraints should be indicated on the plat. No structures/improvements should be associated with areas of geologic hazards/constraints. 2. Table B-1 of Entech’s report indicates that groundwater was encountered in TB-2 at 18 feet. CGS recommends that proposed floor levels are at least three feet (preferably 5 feet) above maximum anticipated groundwater levels and maintained year-round. Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block. b. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of December 5th 2023, the fee for all credit/debit cards has changed from the flat 2.95% fee to the following: Over the phone Credit/Debit Card payments will be 2.3% and In-Person Debit Card payments will be 1.5% (in-person only). c. Pre-plat reviews can be reviewed via “pdf” or in-person. The pre-plat will be stamped by Enumerations for accuracy and returned to the applicant and the planner. All payments to be mailed to RBD via a check or credit card payment over the phone. Plats should not be recorded prior to Enumerations stamping the pre-plat and receiving payment of plat fees. Academy District 20 is in receipt of File # SF2422 for approval of the Flying Horse North Filing No. 4. The District is requesting fees in lieu of land dedication per the existing County Code for all residential units within this development. The District is experiencing ongoing residential development. The District gained approximately 11,000 new residential units between 2018 and 2013 which included 4,595 Single Family, 1,040 Single Family Attached, and 5,612 Apartments as reported to the District by local developers. During that same timeframe, the District only experienced a total membership increase of 171 students. This information is updated annually in October. A drop in the birth rate plus the significant increase in the cost of housing has slowed student growth in the District. The District is able to serve each student who is a resident of District 20. Black Forest Fire Protection District

BFFRPD (Black Forest Fire Rescue Protection District) has reviewed the proposed project. Of concern for BFFRPD operations is the fire department access and fire protection water supplies. While the narrative states they will comply with County Codes and Criteria, the application does not state how they intend to conform with any specificity. Due to the lack of a municipal water system BFFRPD strongly encourages the installation of a cistern for this filing. The County is the Authority Having Jurisdiction (AHJ) that will determine the requirements for cistern and specifications for access/egress. A cistern is required if a subdivision has 6 or more homes being built on it. All structures and street signs need to comply with PPRBD, EL Paso County standards, IBC 2021 and IFC 2021 standards. Our recommendation is the applicant demonstrate full compliance and conformance with El Paso County’s adopted Land Development Code (LDC), Engineering Criteria Manual (ECM), adopted International Fire Code (IFC), and all other adopted codes, provisions, or statutes that impact fire safety to include access/egress, water supply, hardening of structures, addressing, fire protection systems, etc. It is recommended that the applicant submit a comprehensive fire protection report from a qualified fire protection engineer that is licensed as a Professional Engineer (PE) by the Colorado State Board of Registration for Professional Engineers to demonstrate conformance to all requirements. The current fire protection report lacks specificity and detail for how the area will provide sufficient water in the event of a major conflagration. Furthermore, the District does not support any waivers or variances that negatively impact any fire safety provisions including access/egress, water supply, hardening of structures, addressing, fire protections systems, etc. The Letter of intents states, "A brand-new fire station was built to service this area of the Black Forest within FHN Filing No. 1." It is unclear what Fire Station this is referring to. The Fire Station on Hodgen road was built in 2008. |

Please be aware that the above available names have been previously approved multiple times in various locations within different filings associated with the Flying Horse development. We are uncertain as to why these names continue to be moved to different locations between filings, but at this point it is becoming increasingly difficult to determine which names are actually intended for which filing. For clarification, road names must be unique. Once the final plat for one filing has been completely approved, those names will not be used again, even if they had been approved previously on a different filing. Thank you Justin |
