The available referral documents include the Letter of Intent (Matrix Design Group, September 2025), Final Plat (Matrix Design Group, September 8, 2025), Geologic Hazard Evaluation and Preliminary Geotechnical Investigation (CTL Thompson, Inc., Revised September 11, 2025), and other documents. The applicant proposes to subdivide the property into one 13.85-acre lot (Lot 1) for a proposed institutional use (church, school, and/or retirement facility) and four tracts (Tracts A-D). Tract C will consist of a proposed detention pond, and Tract D will comprise the proposed roadway that will traverse the site. The geologic hazard report references multifamily residential use and appears specific only to the west side of the property (Tracts A-C). CGS offers the following comments and recommendations. 1. CTL states (page 2), “Tracts A and B are covered by this report. Should we be engaged to investigate Lot 1 and Tract C the reporting would be under separate cover.” It appears that the application is for Filing No. 1, which includes Tracts A-D and Lot 1. CTL’s report should be updated to include Lot 1 and Tract C-D. 2. The western portion of the site is located within the FEMA floodplain (FIRM 08041C0754G, December 7, 2018) associated with Sand Creek East Fork and contains portions of Tracts A-D. CTL states (page 13), “The project Civil Engineer should determine the extent of the flood mapping for the site, the flood potential, and design surface drainage.” The Letter of Intent states, “These tracts will stay undeveloped at this time but may be developed in the future after a LOMR is processed for floodplain modification.” No structures/improvements should be permitted within designated FEMA floodplain areas. This statement should be added to the final plat. 3. The final plat references CTL’s August 6, 2024 geologic hazard study. This note should be updated to CTL’s revised September 11, 2025 study. 4. CTL states (page 16), “Groundwater was not encountered or measured at depths well below that which would be expected to impact design or construction in most of our borings.” This statement is incorrect. CTL continues, “Groundwater was measured at 6 feet below the existing ground surface in TH-12, and 6.6 feet in TH-14.” Due to the shallow groundwater conditions at this site, basements should NOT be allowed unless mitigation measures (such as raising the site grades) are established and noted in the plans. If basements are planned, CGS recommends that the county require groundwater monitoring/observation to obtain groundwater data for the entire site, which can be used to determine the feasibility of basements and verify that proposed foundation components are at least three feet above the maximum anticipated groundwater levels and are maintained year-round. To be effective, however, this monitoring should include observations through summer, fall, winter, and spring and not merely during site-specific building investigations. 5. The exploration program performed by CTL indicates low blow counts (N-values), as low as 1 in test boring no. 2. According to the Geologic Map of the Elsmere Quadrangle (Madole, R.F. and Thorson, J.P., 2003, CGS OF-02-02), alluvium overlies the Dawson formation at an unknown depth. Collapse-prone soils are listed in CTL's report. We agree with CTL that sub-excavation and reworking of these materials will be necessary. Mitigation measures should be indicated on the final plat. It remains unclear from the documents uploaded what the water demand is and how it was calculated. Please revise the WSIS, Water Resources Report, and commitment letter as necessary to: 1. Provide the estimated demand for the platted lots only, entire property as a whole, in acre-feet, which includes commercial and all anticipated uses. Water sufficiency will not be reviewed for tracts, and tracts will be prohibited from using water. They must be replatted at such time as development is proposed. Note that the identified uses and project description in the Letter of Intent are not consistent with the WSIS, Water Resource Report, and Commitment Letter. 2. Identify the water demand attributed to commercial use (in acre-feet) and that attributed to irrigation of landscaping. 3. Pursuant to Sections 8.4.7 (B)(3)(c)(v) and (e) of the Land Development Code, please add information to the Water Resources Report regarding Cherokee Metro District’s total water supply and its current commitments to serve. 4. Lastly, once these items have been addressed the County Attorney's Office will review for water sufficiency following receipt of findings from the Colorado Division of Water Resources. Tract C will consist of a proposed detention pond and Tract D will comprise the proposed roadway that will traverse the site. The geologic hazard report references multifamily residential use and appears specific only to the west side of the property (Tracts A-C). In addition, CTL’s report refers to a proposed Roadway Grading, Site Utilities and Concept Plan Exhibit prepared by Matrix, Dated May 17, 2024 that does not appear to have been provided in the referral documents. CGS offers the following comments and recommendations. 1. The western portion of the site is located within the FEMA floodplain (FIRM 08041C0754G, December 7, 2018) associated with Sand Creek East Fork and contains portions of Tracts A-D. CTL states (page 10), “The project Civil Engineer should determine the extent of the flood mapping for the site, the flood potential, and design surface drainage.” The drainage study in the referral documents only addresses the eastern portion of the site (Lot 1). CTL’s study does not include a geologic hazards/constraints map; it only includes geologic conditions and engineering conditions. CGS recommends that the county requires a geologic hazards map indicating the hazards/constraints indicated in their report (such as shallow groundwater, collapse-prone soils, flood-prone areas, etc.). No structures/improvements should be permitted within designated floodplain areas. 2. The final plat does not reference CTL’s geologic hazard study, the site’s geologic hazards/constraints, or mitigation measures. Before approval, the final plat must include this information with mapped geologic hazards/constraints. 3. CTL states (page 14), “Groundwater was measured at 6 feet below the existing ground surface in TH-12, 6.6 feet in TH-14, and 9 feet in TH-15.” However, page 5 shows varying groundwater conditions. CGS recommends that additional groundwater information and a discussion on fluctuations in groundwater levels be provided prior to the approval that covers the entire site. The Cimarron Hills Fire Department (CHFD) has completed a review and has no concerns with the request to replat of TSN 5408007001, TSN 5408007004, and TSN 5408007003 as one 14-acre lot and 4 tracts. To include the Meadowbrook Parkway extension both 300’ and 500’ curve radiuses deviation from 565’ required minimum centerline curve radius found in Table 2-7 of El Paso County ECM. No further comments. |
