It is unclear from the documents provided whether the estimated water demand covers both proposed lots or only the new, undeveloped lot. The documents are also inconsistent regarding the uses to which the demand is attributed. Please revise the WSIS, Water Resource Report, and commitment letter as necessary to:
1. Provide the estimated demand for the subdivision as a whole, which includes both lots and all existing and anticipated uses.
2. Identify the water demand attributed to commercial use and that attributed to irrigation of landscaping.
3. If the estimated water demand, whether for the commercial uses, irrigation, or both, is less than the presumptive demand values in Section 8.4.7 (B)(7)(d) of the Land Development Code, please provide justification for the lower amount. This can include, for example, information about demands observed by Cherokee for similar uses in the area.

Colorado Geological Survey

As requested by El Paso County, the Colorado Geological Survey (CGS) has reviewed the application for Seder Subdivision (county project ID VR2319, located at 38.8713, -104.6854). Referral documents include a Soils and Geology Study (Entech Engineering, 2725 Akers Drive, Job No. 231480, October 4, 2023). CGS generally agrees with Entech’s geologic interpretation, identification of hazards and constraints posed by the geology, and recommended mitigation for these conditions. This includes the need for a site-specific soil and foundation investigation for any new construction and to support any Site Development Plan for the undeveloped portion of the site.

The replat (Baseline Corporation, Job No. CO-35072, August 29, 2023) references approval by the City of Colorado Springs (note 7). This should be changed to reference El Paso County.

CGS has no objection to approval of the replat provided a note is added that a site-specific soil and foundation investigation is required for any new construction and that Entech’s recommendations shall be followed in developing this site.

1. The address for Lot 1 will retain the existing address of 2725 Akers Drive, Lot 2 will be 2713 Akers Drive. Please add these addresses to the final plat as close to Akers Drive as possible.
2. There is a permit for a free standing sign on the proposed lot 2, 2744 N Marksheffel Road. Will this sign remain?
3. The correct spelling is Akers Drive, no apostrophe. Please revise the final plat.
4. If/when a development plan is submitted for the new development, additional addresses may be assigned. Any commercial property which has multiple buildings will be assigned separate addresses and possibly secondary addressing based on scope.

Standard Final Plat comments apply:

1. Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block.
2. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of September 28th, 2022, an additional over the phone transaction fee of 2.95% of the total transaction will apply for any credit card payment.
3. A copy of the final recorded plat is required prior to approval in the Enumerations department on any COMMERCIAL plan submittal. Please email the Enumerations staff member that reviewed your project BeckyA@pprbd.org
4. Pre-plat reviews can be reviewed via “pdf” or in-person. The pre-plat will be stamped by Enumerations for accuracy and returned to the applicant and the planner. All payments to be mailed to RBD via a check or credit card payment over the phone. Plats should not be recorded prior to Enumerations stamping the pre-plat and receiving payment of plat fees. If any pre-plat changes occur, even if changes do not apply to Enumerations, we still need to re-stamp the pre-plat. The Enumerations stamped pre-plat copy should match the recorded document minus a few signatures. I have serious concerns about moving forward with this application given the length of time the Code Enforcement case has been opened (2015). CDPHE has also been extensively involved with this property over the waste piles. The owner has had years to address the waste shingles on the property. I am requesting a plan and firm deadline for the removal of the waste shingles from the property owner/applicant and I would recommend this application not move forward until the property is in compliance.

11.3.1 (E) Relationship Between Development Application and Violation. A development application shall not be initiated or accepted for submittal by the PCD if the property subject to the application is in violation of this Code unless the purpose of the development application is to correct the violation, or unless specific authorization for submittal is granted by the PCD Director. The PCD Director may suspend any enforcement action prior to such action being heard by the BoCC while an application to correct or resolve the violation has been submitted.
