Upon research and thorough review of the title commitment, staff is unable to verify through past deeds or instruments that Nevada Lane is private and can closed and gated with restriction to public use. Staff will need proof through recordation, etc that there exists no easement on Nevada Lane that gives access to other properties before approving the closure of Nevada Lane for public access and use. See engineering comments on Notice of Intent and Site Plan Drawing attached. |
