The private road/access easement cross section does not meet LDC 6.3.3.C.2 and LDC 6.3.3.C.3 for cross section width minimum of 24ft for the two-way non road access std. This is for a non-public private road or a non-road access per the aforementioned criteria. A deviation request should be submitted for the road cross section width/design and concurrence from the FD.

EPC maintains full authority over the LDC and ECM. Any deviations, variances, or non-conformance to their own adopted standards are the sole responsibility of the County and not BFFRPD. Furthermore, BFFRPD lacks the technical training/education or qualified/certified personnel to review and determine conformance. The Black Forest Land Use Committee recommends DENIAL of this proposal.

1. Even though the county master plan says densities should be no less than 2.5-acres per lot, this area has a precedent of 5 acre averages for the past 50 years. The increased density is a strain on water, traffic, wildlife and natural resources.

2. The master plan calls for conservation design which is hard to define on this treeless lot that was burned in the Black Forest fire. There is a small 20-foot trail easement around the property which is a positive factor.

3. The master plan also calls for compatibility with surrounding lots. The lots on the north, west and south side are all 5 acres or larger. On the narrow eastern side where a 2.5-acre lot is proposed, the Meadow Glen development consists of 2.5-acre lots platted in the 1960s before zoning was established in the county. We recommend retaining this lot to match those 2.5-acre lots and combining the two 2.5-acre lots on the west side into one 5-acre lot. Combined with the proposed 7-acre lot, the density would be slightly less than 5 acres per lot.

Changing the proposal from 4 lots to 3 lots would conform to the area and be compatible.

As requested by El Paso County, the Colorado Geological Survey (CGS) has reviewed the application for Fairytale Acres Subdivision (located 39.0208, -104.6798). Available referral documents include a Soils and Geology Study, Fairytale Acres Subdivision, 13055 Herring Road, Parcel No. 52090-00-030, El Paso County, Colorado (Entech Job No. 230131, revised May 23, 2023). Entech notes that the site contains constraints to development imposed by geology. They have identified and discussed the potential for expansive soils and bedrock, high groundwater, and erosion.
CGS recommends that the Soils and Geology report be updated before the approval of the subdivision. The report should discuss the other constraints and hazards posed by geology. These include shallow bedrock, potential for perched groundwater, erosion, radiation (radon), and seismicity.
Entech states, p.3, “It is anticipated groundwater will not affect shallow foundations on the majority of the site.” The feasibility of below-grade habitable areas should be specifically discussed, or a plat note should be added that states no basements or below-grade habitable construction are allowed in areas that will be impacted by the “anticipated groundwater.”

Regarding a request for approval of a final plat for Fairytale Acres Subdivision, Enumerations has the following comments:

1. All addresses for this project will be assigned from Fairytale Heights. Submit a copy of this plat to Enumerations for address assignment.
2. The existing residence which currently uses the address of 13055 Harding Rd. will need to have an address change performed. Instructions for requesting an address change can be found here: https://www.pprbd.org/Download/Addressing#AddressingJump This request needs to accompany the plat when submitted to Enumerations for approval.
3. Prior to recording, Enumerations will review the mylar for addressing and title block. The Enumerations fee due at the time of mylar review is $40. This is a separate fee from the fee for the address change that needs to accompany this mylar.

Upon review of the fire protection report, I am uncertain where the information is being obtained. It appears to be using inaccurate reference materials and therefore does not give an accurate operational assessment for the property. The county must be aware that old information recycled can be outdated and inaccurate. Additionally, the statement "No cistern is being proposed at this time, nor has one been requested by the Black Forest Fire Rescue Protection District" could be misleading. Specifically the part "nor has one been requested" may give the reader the impression that the fire district doesn't want one. The issue is one of authority, recommendations versus requirements. The fire district has zero authority regarding the adoption, enforcement, revision, or waivers of the LDC, ECM, or IFC. Our preference will always be that water be readily and immediately available for every structure fire. However, that authority is solely the County's. The LDC delineates when the applicant must provide a cistern per County Code, not Fire District preferences. Finally, the most concerning aspect of this report was the inclusion of a tool we are using for developing our community wildfire mitigation program. The inclusion of this tool has forced an immediate internal change to BFFR. The wildfire risk assessment tool is for us to build a strategic and comprehensive community wide mitigation plan. To include this document in the application without the context of its scope and purpose is misleading.

Other overhead aspects of the report are fine such as ISO and distance. Our departments station are 24/7, not typically 24/7.
