It further states on p. 52 that Lots 1-3 of this replat will create an estimated water demand of 2.66 acre-feet/year. Water sufficiency for Claremont Business Park 2 was found in connection with BoCC approval of the preliminary plan. It appears that this application proposes to replat 3 lots of Claremont Business Park 2 Filing 1 (Lots 8, 9, 10) into 3 new lots. The County Attorney’s Office recommends that Applicant consider whether it qualifies to request an exception from the water supply requirements of the Code based on the 4th bullet in Section 8.437 (A)(3), which states:

“The requirements set forth in this Section shall not apply to: … A vacation or vacation and replat of an existing subdivision or lots within an existing subdivision or any plat change, any of which will not result in significantly greater total water use than previously anticipated for the subdivision. All determinations as to the significance of the change in water use shall be made by the BoCC, with recommendations by the CAO….”

If Applicant elects to request the exception, it should submit sufficient documentation, to be reviewed by this office, that the reconfiguration of the 3 lots will not result in significantly greater total water use than previously proposed.

Sufficiency was found at the preliminary plan, with a condition that the final plat be approved by 8/6/21 based on Cherokee’s conditional commitment letter. Filing 1 was not approved until 9/28/22, more than a year after the deadline passed. No updated water documents were provided in connection with the final plat, and no water review was done by the County Attorneys Office. Filling 1 was therefore approved and recorded without a sufficiency finding in place.

An updated commitment letter for Filing 1 should then be provided to the project manager.

Claremont Business Park No. 2 has been previously reviewed by CGS on May 11, 2017 and January 5, 2018 (SP-17-004, 16 lots), January 8, 2020 (SP197, 11 lots), and July 3, 2020 and January 19, 2021 (SF2014 10 lots). The site (38.8531, -104.684) does not contain steep slopes, is not undermined, and contains no geologic hazards or unusual geotechnical constraints present that would preclude the proposed commercial/industrial uses and density.

The letter of intent (MS Civil Consultants, Inc., undated) references a geology/soils report prepared by Terracon Consultants, Inc., dated May 30, 2006, with a letter from Terracon (6/17/2020) confirming that the 2006 conclusions and recommendations remain applicable. CGS recommends site-specific investigations for individual commercial structures, including testing and analysis for designing foundations, floor systems, subsurface drainage, pavements, etc., and to investigate the engineering properties of the eolian, alluvial, and artificial fill mapped within the site.

Provided Terracon's recommendations are adhered to, and site-specific investigations are performed, CGS has no objection to approval of the replat as proposed. CGS recommends that a note be added to the final plat requiring site-specific geotechnical investigations once building locations have been determined.

Sewer and water plans are rejected for the following reasons:
-Many water and sewer crossing vertical clearances less than the 18" required by CMD standards
-Water and sewer moves in and out of public utility easement, identify infrastructure as either all private or all public completely within utility easement
-Northern sanitary sewer connection is marked as a service at tie in but has a manhole and additional connections in new construction, public sewer mains must be a minimum of 8 inches to facilitate cleaning

See attached administrative comments on behalf of El Paso County Parks. The 2023 El Paso County Parks Master Plan shows no planned regional trail, potential park site, or candidate open space being impacted by this project. The proposed Marshfield Road Bicycle Route is located along Marksheffel Road immediately east of the project boundary. This bicycle route will be accommodated within public right of way.
