Pursuant to Section 5.2.19 (B)(6) of the Land Development Code, tower removal agreements are only required for freestanding CMRS facilities. Condition of approval no. 4 for the special use granted in 2009 requires "financial surety sufficient to cover the cost of removal by the County in the event of abandonment." If no such collateral is currently in place, it must be provided with this application. A tower removal agreement is required only if this is a "freestanding" CMRS facility. The Land Development Code defines a freestanding CMRS facility as "a CMRS facility that consists of a stand-alone support structure, such as a tower or monopole, and antennae and accessory equipment." If the CMRS facilities at this site are attached to what is otherwise a mining or other structure, then no agreement is required. If, however, the facilities are attached to a freestanding pole located within the mining structure, then an agreement is required. |
