Prior to installing City ROW improvements, submit street and signage construction plans to EDRD and Traffic Engineering through our electronic review system called ProjectDox for review and approval. Financial assurances for all public ROW improvements shall be posted to the City prior to approving the construction plans. The amount to be submitted to the City will be agreed upon at that time. The public ROW improvements will follow EDRD's probationary and final street acceptance procedures. Reference Chapter 11 in the Subdivision Policy Manual for information.

With this referral, CGS reviewed the soils and geology study (Entech Engineering, Inc., February 17, 2023). Entech’s characterization of the geologic hazards and constraints associated with the site is valid. Provided Entech’s recommendations are adhered to, and design-level geotechnical studies are performed, CGS has no objection to approval of the preliminary plan. We offer the following comments for consideration.

1. The geologic hazards and constraints identified in Entech’s report should be listed in the preliminary plan.
2. According to the preliminary plans, retaining walls are planned within the development. CGS agrees with Entech (p. 11), “Retaining walls should be designed for global stability. All slopes should be evaluated for local and global stability for final designs.”
3. CGS recommends Entech be retained to review the project plans and specifications for conformance with the recommendations provided in their report.

Traffic:
CDOT agrees with the improvements listed in Table 3 of the traffic study as follows:
1. Provide additional southbound left turn storage lane and lengthen mast arm to accommodate signal indication at Pow
and Bradley;
2. Both northbound right-turn deceleration lanes at Powers and Bradley shall be lengthened by this development, (dual
right turn lanes will be the responsibility of Villages at Waterview North); and
3. The need for Powers & Bradley interchange in 2040 is not indicated by the study and no escrow will necessarily be
required, however right-of-way dedication will be required for the ultimate future NB off ramp.
Hydraulic Comments:
Plan comments:
1. In the final plan drawings, please provide drainage plans and pond details.
2. Please specify erosion control measures for Pond 3 outlet pipe on erosion control plans.
Report Comments:
In the final drainage report, please address the following items:
1. The rainfall inputs on the MHFD-Detention sheets are less conservative than Atlas 14 values for both the 50-year an
100-year storms. Please use Atlas 14 values for site coordinates for sizing the extended detention basins (EDBs).
2. Please define the EDB zones on the Detention Basin Stage-Storage Table Builder sheets in the MHFD-Detention
workbook.
3. Please provide the completed Detention Basin Outlet Structure Design spreadsheet from the MHFD-Detention workb
for each EDB.
4. Please provide a comparison of pre-development/existing and post-development/proposed site flows to CDOT rightway.
Environmental:
There may be prairie dogs in the project area adjacent to CDOT ROW, if so, how will they be managed?
Materials:
Please refer to the Terms and conditions of the Access Permit Requirements.

Access Comments:
1. Section 1.4(1) of the State Highway Access Code, states in part that no person, shall construct any access providing
direct vehicular movement to or from any state highway from or to property in close proximity or abutting a state highway
without an access permit issued by the designated issuing authority with the written approval of the Department.
2. Under Section 2.6 (Change in Land Use and Access Use) of the State Highway Access Code, states the requirement
a new access permit. It states in part that if any significant changes are made or will be made in the use of the property
which will affect access operation, traffic volume increases by 20% and or vehicle type, the permittee or property owner
coordinates with the local authority and the Department to determine if a new access permit and modifications to the
access are required.
3. A CDOT Access Permit will be required for this development. Please make contact with the CDOT Access - Arthur
Gonzales for process and procedures.
4. Roadway improvements, right of way donation and signal intersection work will be required for this permit and detailed
the terms and conditions.

1. Previous Enumerations comments stated that there is sufficient addressing available from Frontside Dr. for this development. This application includes a Private Road Waiver, and mentions private roads multiple times. Is the intention to name the interior drive aisles in this project? If so, then a proposed street name needs to be submitted to Justin Annan and Glenn West at El Paso/Teller 911 for approval. If a street name is established for this area, then addressing will be assigned from either this internal street or Frontside Dr. as appropriate.

Airport staff recommends no objection with the following conditions:

• Avigation Easement: Proof of Avigation Easement filing on plan (Recorded in Book 2478 at Page 304); no further action is required.
• Noise: The property is located outside the 65 DNL noise contour, but due to the proximity of the development in relation to the noise contour, an indoor noise reduction is recommended. Per Note No. 21 on the plan - a 30 DB(A) indoor noise reduction shall be achieved by approved construction techniques as evidenced by a noise reduction certificate prior to site development plan approval.
• Accident Potential Zone 1: The proposed development is within the Accident Potential Zone 1 (APZ-1) subzone of the Commercial Airport Overlay District, as adopted by El Paso County. Commercial development is permissible in the APZ-1 subzone.
• FAA Form 7460-1: Based on elevation data and distance to runway, the applicant will need to file Federal Aviation Administration (FAA) Form 7460-1 “Notice of Proposed Construction or Alteration” for any new vertical development at this site, including temporary construction equipment, and provide FAA documentation to the Airport before the commencement of construction activities; FAA’s website (https://oeaaa.faa.gov/oeaaa/external/portal.jsp).

Driveway definition requires private or public road:

Driveway — A facility for the passage of vehicles that provides access from a public or private road to no more than 3 lots. Chapter 1 Code

Road — A facility for the passage of vehicles that where appropriate may include pedestrian, equestrian, and bicycle facilities.

Road, Maintained — A road that has been accepted by El Paso County, a municipal government, or other government agency for maintenance.

Road, Non-Arterial — Those roads not designated as arterial roads or above by the MTCP.

Road, Private — Privately-owned and privately maintained road provided for by a tract, easement or other legal means, typically serving more than 3 lots, parcels, or tracts that do not have frontage on a public road right-of-way. Access to these facilities by the public is restricted. Like public roads, these facilities shall be built to public road standards, unless otherwise dictated by provisions within this Code.

List the utility providers in the notes on sheet 1 please.

It is difficult to determine where the lot lines, tracts, private roads are on the preliminary plan sheet 2. The text is very difficult to read. Remove the buildings, and gray back the parking- identify that a cross access ingress egress parking easement is proposed. Depicting the exact parking lot and building locations limits the purchaser from developing the lots to their unique needs. Platting the lots, private road tracts without locating proposed buildings is typically done.

The Subdivider(s) agrees on behalf of him/herself and any developer or builder successors and assignees that Subdivider and/or said successors and assigns shall be required to pay traffic impact fees in accordance with the El Paso County Road Impact Fee Program Resolution (Resolution No. 19-474), or any amendments thereto, at or prior to the time of building permit submittals. The fee obligation, if not paid at final plat recording, shall be documented on all sales documents and on plat notes to ensure that a title search would find the fee obligation before sale of the property.

Traffic:
CDOT agrees with the improvements listed in Table 3 of the traffic study as follows:

1. Provide additional southbound left turn storage lane and lengthen mast arm to accommodate signal indication at Powers and Bradley;
2. Both northbound right-turn deceleration lanes at Powers and Bradley shall be lengthened by this development, (dual-right turn lanes will be the responsibility of Villages at Waterview North); and
3. The need for Powers & Bradley interchange in 2040 is not indicated by the study and no escrow will necessarily be required, however right-of-way dedication will be required for the ultimate future NB off ramp.

Hydraulic Comments:
Plan comments:
1. In the final plan drawings, please provide drainage plans and pond details.
2. Please specify erosion control measures for Pond 3 outlet pipe on erosion control plans.
Report Comments:
In the final drainage report, please address the following items:

1. The rainfall inputs on the MHFD-Detention sheets are less conservative than Atlas 14 values for both the 50-year and 100-year storms. Please use Atlas 14 values for site coordinates for sizing the extended detention basins (EDBs).
2. Please define the EDB zones on the Detention Basin Stage-Storage Table Builder sheets in the MHFD-Detention workbook.
3. Please provide the completed Detention Basin Outlet Structure Design spreadsheet from the MHFD-Detention workbook for each EDB.
4. Please provide a comparison of pre-development/existing and post-development/proposed site flows to CDOT right-of-way.

Environmental:
There may be prairie dogs in the project area adjacent to CDOT ROW, if so, how will they be managed?

Materials:
Please refer to the Terms and conditions of the Access Permit Requirements.

Access Comments:
1. Section 1.4(1) of the State Highway Access Code, states in part that no person, shall construct any access providing direct vehicular movement to or from any state highway from or to property in close proximity or abutting a state highway without an access permit issued by the designated issuing authority with the written approval of the Department.
2. Under Section 2.6 (Change in Land Use and Access Use) of the State Highway Access Code, states the requirements of a new access permit. It states in part that if any significant changes are made or will be made in the use of the property which will affect access operation, traffic volume increases by 20% and or vehicle type, the permittee or property owner will coordinates with the local authority and the Department to determine if a new access permit and modifications to the access are required.
3. A CDOT Access Permit will be required for this development. Please make contact with the CDOT Access - Arthur Gonzales for process and procedures.
4. Roadway improvements, right of way donation and signal intersection work will be required for this permit and detailed in the terms and conditions.

Per Appendix C of the El Paso County Engineering Criteria Manual and Section 8.4.9 of the El Paso County Land Development Code, a geologic hazard study should also be performed. The submitted subsurface soil investigation (Entech Engineering, Inc., May 25, 2022) does not discuss the site geology nor directly discusses the potential geologic hazards associated with the site. If a geologic hazard report was performed earlier in the review process, we would appreciate a copy for our records. Even so, the site does not contain steep slopes or flood hazards, nor is it exposed to any unusual geologic hazards that preclude the proposed commercial development. Entech’s preliminary geotechnical recommendations appear appropriate to address the potential geologic constraints identified at this site, including expansive clay soils. However, we have the following comments.

1. Entech’s seven borings were drilled to a depth of 20 feet. The Grading and Erosion Control Plan (Kimley Horn and Associates, Inc., May 6, 2022) indicates that significant cuts and fills are planned, with cuts around 20 feet in some areas. Therefore, some of Entech’s borings, including TB-1 in the northwestern area of the site, may not extend to sufficient depths to provide meaningful information about soil and bedrock engineering properties and groundwater levels. Additional investigation, sampling, testing, and analysis will be needed to characterize subsurface conditions and determine the depth and extent of overexcavation if overexcavation is planned. CGS agrees with Entech (page 4), “Additional subsurface soil investigations are recommended when building locations and grading plans are determined.”

2. Several stormwater detention/water quality ponds are proposed within the tracts. CGS recommends that future geotechnical studies provide specific recommendations for the proposed detention areas, such as embankment recommendations, liner requirements, slope requirements, erosion protection, etc.

3. The Soils & Geology Conditions, Constraints & Hazards Notes on the Preliminary Plan (Kimley Horn, August 22, 2022) references a Geologic Hazards Evaluation and Preliminary Geotechnical Investigation for Crossroads North by CTL Thompson. These notes should be updated to include Entech’s report and the subject site.

4. According to the preliminary plans, retaining walls are planned within the development. CGS agrees with note 12 of the preliminary plans, “Retaining walls exceeding 4-feet will need to be structurally engineered.” This analysis should be performed to evaluate requirements for achieving and maintaining long-term slope stability with a FOS of at least 1.5. The slope stability analysis must use site-specific soil density, shear strength values, and higher-than-observed water levels to reflect reasonable post-rainfall levels.

5. CGS recommends that Entech be retained to review the project plans and specifications for conformance with the recommendations provided in their report.
