PRIOR TO RECORDING THE FINAL PLAT:
1. Please upload to eDARP the recorded water decree.
2. The deeds for conveying lots need to contain the language found in paragraph E of the water review. They also need to convey total amounts of water in each aquifer, not annual amounts. These amounts must include a minimum of 225 acre-feet of water in the Dawson aquifer and 225 acre-feet in the Laramie-Fox Hills aquifer. See paragraph D of the water review.

Also, the Declaration of Easements is not needed, based on previous comments by the County Attorney's Office. Please do not record.

NOTE: The project is scheduled for Planning Commission hearing on November 3. Staff requests the applicant attempt to address the above comments and resubmitted prior to hearing. The goal is to have all engineering documents approved by the hearing date.

It appears that the easement recorded in 2004 already gives the entirety of this parcel, and therefore the proposed Lots 1-3 access via the recorded easement. Further, the recorded easement states that "... the Grantor and Grantees... shall jointly construct and maintain the easement.... The parties agree that they shall equally share all costs of construction, maintenance and repair of the easement...." It therefore does not appear that a new declaration of easements is necessary. 1. The three address assignments are as follows: Lot 1 will retain 18735 Brown Road, Lot 2 will be 18763 Brown Road and Lot 3 will be 18795 Brown Road.
2. Please be sure to add the addresses to the final plat when submitting for final review prior to recordation of plat.
3. Please add the street name to the final plat.
4. On top title block of the final plat, suggest changing the section information to read as follows “ LOCATED IN THE SOUTHWEST QUARTER OF SECTION 7, TOWNSHIP…”

FINAL PLAT COMMENTS APPLY:

1. Enumerations will review the mylar prior to plat for address placement, street names, and title block.
2. A $10.00 per lot and tract platting fee will be due at the time of the review of the mylar, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. An additional over the phone transaction fee of $3.50 will apply for any credit card payment.

As noted on page 15 of the Soils and Geology Report (Rocky Mountain Group (RMG), stamped February 8, 2022), “Geologic hazards found to be present at this site include faults/seismicity and radon. Geologic constraints found to be present at this site include expansive soils, compressible soils, and artificial fill.” RMG describes the site as containing potential expansive and compressible soils, although no laboratory testing was performed. A drainage channel traverses the site that RMG maps on the Engineering and Geology Map (figure 6) as a “seasonally wet area” and is shown on the plat as a “no build area.” RMG also mapped several areas within lots 1, 2, and 3 as “potentially seasonally wet areas”. Plat note 11 (Minor Subdivision Plat (MVE, Inc., March 23, 2022)) indicates that potentially shallow groundwater exists on lots 2 and 3 with mitigation measures provided, but lot 1 was not listed.

The conclusions and identification of geologic hazards and constraints in RMG’s report are based on three test pits excavated to 8 feet below the existing ground surface within the proposed on-site wastewater treatment system (OWTS) locations. CGS recommends that the county require the soil, geology, and wastewater study to be expanded to evaluate the geologic constraints based on a site-specific investigation and data. This type of investigation typically includes test borings drilled to a sufficient depth (generally at least 20 feet) to determine groundwater and bedrock depths where both are likely to be shallow. If shallow groundwater is encountered or expected based on the subsurface conditions, the report should discuss the expected seasonal groundwater fluctuation expected at the site based on site-specific data and the feasibility of basements or other anticipated habitable below-grade space.

CGS agrees with RMG’s recommendation (page 16) “The foundation systems for the proposed single-family residential structures and any retention/detention facilities should be designed and constructed based upon recommendations developed in a site-specific subsurface soil investigation.” This recommendation is correctly noted on the plat.
