Comments on draft covenants: 1. Please specify the specific amounts in AF of Laramie-Fox Hills aquifer water and Arapahoe aquifer water that will be deeded to each lot, pursuant to Requirement C.1 of the Water Supply Review 2. Please include language that no irrigation or animal watering may occur on a particular lot until an occupied single-family dwelling is generating septic return flows, pursuant to Requirement C.3 of the Water Supply Review 3. Please make sure the provisions regarding amendment and termination are the same as or substantially similar to the language in Requirements C.6 and 7 of the Water Supply Review 4. In the section addressing the access easement, I recommend you refer to it using the same language that is on the plat to avoid confusion. The plat identifies a 35' access easement. The covenants identify a 20' Shared Access Driveway. Please reconcile. Additional comments: 5. Please add the note to the plat found in Requirement I of the Water Supply Review 6. 1. Plat notes 10 and 11 are duplicative. Please delete one. 2. Amend plat note 12 to reflect that access responsibilities are in the covenants, not an access agreement. 3. The covenants refer to a 20' "Shared Access Driveway" that is depicted on the plat. That is not the wording used on the plat, and the easement is 35' wide on the plat. Please ensure the wording used is consistent across all documents. 4. Paragraph 2.C says that maintenance costs will be equally divided, then says that they shall be allocated based on lot access, and paragraph 2.B says that costs will be allocated pursuant to some future agreement. To avoid internal inconsistency and future conflict, I recommend that the specific allocation (e.g. 50/50, 60/40, etc.) be identified and all other conflicting provisions be deleted. 5. In paragraph 2.C, change "appliable" to "applicable." |

The available referral documents include the Final Plat (MVE, Inc., March 24, 2023), Letter of Intent (MVE, Inc., March 24, 2023), and Soil, Geology, and Geologic Hazard Study and OWTS Wastewater Study (Entech Engineering, Inc., November 2, 2022). The site does not contain any unusual geologic hazards or geotechnical constraints that preclude the proposed two-lot minor subdivision. As noted on page 5 of Entech’s report, “The engineering geologic constraints identified on this site include artificial fill, potentially expansive soils, and potentially seasonal shallow groundwater….” The final plat indicates the steep drainage easements traversing the lots are “No Build and No Storage of Materials.” Entech also notes (page 5) that construction is not proposed within these steeply sloping drainage areas/easements. Entech’s characterization of the geologic hazards and constraints associated with the site is valid. Provided Entech’s recommendations are strictly adhered to, CGS has no objection to approval of the minor subdivision as proposed. 1. Project statement on the EDARP states this project is “plat amendment for 3 lots to 1 lot”. Looks to be 1 lot to 2 lots. 2. Current address to the single lot is 8855 Walker Road. New lot address will be 8835 Walker Road. Add this address to the plat. 3. FINAL PLAT: a. Enumerations will review the mylar prior to plat for address placement, street names, and title block. b. A $10.00 per lot and tract platting fee will be due at the time of the review of the mylar, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of September 28th, 2022, an additional over the phone transaction fee of 2.95% of the total transaction will apply for any credit card payment. THIS PLAT WILL BE FOR $10.00. c.
