2. First WHEREAS clause needs to be amended to reflect that this plat was approved by the PCD Director through a Record of Administrative Action.
3. If escrow funds have previously been received for either of these intersections, please ensure that the names of the respective funds are consistent with those used in previous agreements.
4. Please make sure the blanks in paragraphs 4 and 5 are filled in with the date 20 years from plat approval.

In response to our 5/4/2023 comments, an additional note was added to the final plat for Filing 2 (J.R. Engineering, May 12, 2023). General Note 26 states, “The potential for shallow water exists on Lots 15, 16, and 20 to 32. The lowest floor levels should be constructed a minimum of 3 feet above water levels…Site-specific investigation including groundwater monitoring/observation on every lot within Filing No. 2 is required to determine soils conditions and determine depths to water and fluctuations in groundwater levels.”

Provided a groundwater monitoring/observation program is performed on each lot to determine the fluctuation of water levels, CGS has no further comments.

In response to our 3/15/2023 comments, Entech provided a letter that presents more groundwater data and specific lots in which shallow groundwater conditions are a concern. Based on the data, groundwater measurements were obtained in 12/2018, 4/2019, and 1/2022 from various test holes/pits within Filing No. 2. As stated in CGS’s previous letter (12/14/2020), seasonal fluctuations of shallow groundwater cannot be determined by a single point in time and fluctuations of groundwater levels are important to understand.

On 4/3/2023, CGS, the El Paso County Planner, and project team members met via Microsoft Teams to discuss CGS’s 3/15/2023 comments and recommendations. CGS indicated the need for a discussion on groundwater fluctuations from the geotechnical consultant (Entech). Groundwater measurements from various test holes/pits around the site for a portion of the year does not constitute a groundwater monitoring/observation program. As stated numerous times for this development, this monitoring should include measurements/observations through fall, winter, summer, and spring.

As noted in Entech’s 4/26/2023 letter, a proposed plat note was provided. CGS recommends the following statements in the proposed plat note be revised:

• “Structures should be constructed a minimum of 3 feet above water levels” revised to “The lowest floor levels should be constructed a minimum of 3 feet above water levels”.

• Also, instead of “Investigation on each lot….”, revise to “Site-specific investigation including groundwater monitoring/observation on every lot within Filing No. 2 is required to determine soils conditions and determine depths to water and fluctuations in groundwater levels.”

Since this project site is within an area of known shallow groundwater issues, CGS also recommends that Entech discuss the fluctuation of water levels in this area based on a groundwater monitoring/observation program. CGS has recommended this be performed for this project since the preliminary plan submittal for this development.

2. Standard Final Plat comments apply;
a. Enumerations will review the mylar prior to plat for address placement, street names, and title block.
b. A $10.00 per lot and tract platting fee will be due at the time of the review of the mylar, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of September 28th, 2022, an additional over the phone transaction fee of 2.95% of the total transaction will apply for any credit card payment. For this project there are 42 lots & Zero tracts with addresses.
c. A copy of the final recorded plat is required prior to plan submittal for RESIDENTIAL. Amy@pprbd.org
d. Mylar reviews can be reviewed via “pdf”. The mylar will be stamped by Enumerations for accuracy and returned to the applicant and the planner. If subdivision proposals are located within three hundred (300) feet of a Zone A floodplain, FEMA approved base flood elevations and boundaries are required to be determined and shown on the plat, or provide a Floodplain Certification Letter by a professional engineer or architect licensed by the state of Colorado, stating that “Based on field verified characteristics of the property, the property is reasonably safe from flooding and to the best of the engineer’s knowledge if the 100-year floodplain were studied it would not enter the property in question”.

1. Addressing is required on all corner lots on both sides of the lot. When submitting for the addressing plan, once the PUD/DP is approved, the addressing markers (xxx) need to be shown on both sides of the corner lot.
2. Lots 38-39 of filing No. 1 are addressed as Benito Wells Trail. Remove Oscuro Trail Street name for this filing in this location.

The letter of intent (dated July 2, 2021) correctly states: The Colorado Geological Survey’s review comment of the geotechnical report (as posted on EDARP) indicates:

"Provided Entech's recommendations are adhered to, and lot-specific investigations and
analyses are conducted for use in design of individual foundations, floor systems, subsurface
drainage, and pavements, CGS has no objection to approval of the 218-lot residential
subdivision as proposed. "

As such, prior to construction of proposed residences, lot-specific subsurface soil investigations
will be performed to determine whether or not shallow groundwater, hydro-compacted soils,
and/or potentially expansive soils are present on the lot, and to determine an appropriate
foundation design, basement or crawl-space suitability, and/or lot-specific recommendations
are necessary to mitigate these conditions. Language requiring lot-specific subsurface soil
investigation will appear as a Note on the Final Plan.>>

This note is not apparent on the Final Plat Drawings (dated June 3, 2021) provided for this review. Additionally, the geotechnical report by Entech was revised (April 24, 2020) after our initial comments and CGS provided additional comments and data (December 14, 2020) during the preliminary plan submittal not referenced in the letter of intent. These additional comments and data indicate potential for shallow and perched groundwater cannot be determined solely on lot-specific subsurface soil investigations during development. Due to this, CGS recommended on December 14, 2020 that the drain systems presented by Entech be considered for all areas within the subdivision with below-grade habitable construction. These comments have not been addressed by the applicant or their consultants.

CGS recommends that the note on the Final Plan include language that “As the potential for shallow and perched groundwater cannot be determined during lot-specific subsurface soil investigations it is recommended that lots where basement or crawl-space is desired consider drain systems as recommended by Entech for areas with shallow groundwater”. CGS has provided precipitation data and reasons why this is recommended in our letter dated December 14, 2020, which is considered a part of this current review.
