Please note that El Paso County Public Health must make a finding of sufficiency with regards to water quality and the County Attorney's Office must make a finding of sufficiency with regards to water quantity and dependability prior to scheduling for public hearing if you are seeking a water sufficiency finding at preliminary plan stage. With this referral, we received a Letter of Intent (N.E.S., Inc., April 2021) and a Preliminary Plan (N.E.S., Inc., April 22, 2021). Three additional lots are being created by dividing two 10-acre lots into four 5-acre lots and adding a 7.58-acre lot into the 87.668-acre Tract D open space. Sheet 3 of the preliminary plans, “Potential Building Constraints Map,” identify shallow groundwater (sw), potentially seasonal shallow groundwater area (psw), and downslope creep area (dsc) that Entech Engineering, Inc. previously mapped (Preliminary Soil, Geology, Geologic Hazard, and Wastewater Study, Revised January 11, 2019) impacting proposed lots 10 through 13 and 28. Provided Entech’s recommendations are adhered to, drainage easements are avoided or properly mitigated during construction, and lot-specific investigations and analyses are conducted, CGS has no objection to the approval of the preliminary plan amendment for the additional lots.

General Note 1 should be updated in Sheet 3 of the preliminary plans to indicate Entech’s revised report for the Winsome Subdivision dated January 11, 2019.

On April 28, 2021, the U.S. Fish and Wildlife Service (Service) received through EDARP a request to review documents associated with the Winsome Preliminary Plan Amendment near Colorado Springs, CO, File #: SP212. This request is tied to previous reviews of the Winsome subdivision proposal by the Service in 2019 (2019-TA-0422), and the Winsome Filing No. 2 Final Plat earlier in 2021 (2021-TA-0568). Each of the previous determinations by the Service indicated we had no concerns with this project resulting in impacts to species listed as candidate, proposed, threatened, or endangered, if the developer is committed to implementing the conservation measures as previously described. The additional development design elements described in the Winsome Preliminary Plan Amendment are consistent with our previous determinations if the developer is still committed to implementing these conservation measures.

For the majority of this proposal where the primary wildland fuel type is grassland with scattered trees having a low wildfire hazard potential, no special fire mitigation plans or other actions are necessary for final approval by the Colorado State Forest Service.

On the forested areas within this proposal, the Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in the CSFS "Home Ignition Zone Guide" (attached, formerly known as "Quick Guide FIRE 2012-1: Protecting Your Home From Wildfire")

In addition, we recommend that all wildfire mitigation be completed before or during dwelling construction.

1. Compliance with Regional Building Code section RBC313.18.5 will be required.
2. No plats for this area can be recorded prior to the effective date of the LOMR currently in process. Contact Floodplain Administrator Keith Curtis (keith@pprbd.org, 719-327-2898) with any questions or concerns regarding compliance with floodplain code.
The floodplain needs fema approved BFEs prior to final plat which means an Effective LOMR will need to be in place prior to plat. please provide status of the LOMR and case number .
