Please upload documentation showing a transfer of Denver water rights from McCune to Winsome LLC regarding Determination 1691-BD in the amount of 1,500 acre-feet (5 acre-feet/year x 300 years). Also, the Water Resources Report refers to a transfer of Denver of water rights in the amount of 60 acre-feet which appears to be an error. If that's in error - please upload corrected Water Resources Report. Also, the Colorado Division of Water Resources refers to Replacement Plan No. 3 re: 1691-BD - please upload that document as well or let me know where I can find it on EDARP. The U.S. Fish and Wildlife Service (Service) previously reviewed information associated with the proposed construction of the Winsome Development in 2019 (2019-TA-0422). The Service maintains that we have no concerns with this project resulting in impacts to species listed as candidate, proposed, threatened, or endangered, if the developer is still committed to implementing the conservation measures described on page 20 of the attached memo from Ecosystem Services sent to the Service on January 10, 2019.

If the developer wishes to include the subdivision in Public Improvement District No. 2, please complete the attached petition in full and submit to the County Attorney's Office, along with a legal description of the subdivision in Word.

State law requires that legal notice of the BoCC hearing to include the property in the PID be published for three weeks. Developer is responsible for reimbursing the County Attorney's Office for the cost of publication.

The inclusion hearing must be held before the plat is recorded and requires 3 weeks of published notice. The County Attorney's Office makes every attempt to schedule the inclusion hearing on the date of BoCC or administrative approval of the plat, or as close thereto as possible. The developer and County Planning are responsible to keep the County Attorney's Office informed of the anticipated plat approval date.

Regarding a request for approval of a final plat for Winsome Fil. No. 2, Enumerations has the following comments:

1. When submitting a copy of this plat to Enumerations for address assignment, include a copy of the entire development since multiple streets continue into future phases. This will ensure correct and consistent address assignment.
2. Per Regional Building Code, section RBC312.8 addresses must appear on plats. Submit a 100 scale copy of the plat to our office for addressing. Place an (xxxx) on all lots and tracts which will require an address, in the location the address will be needed. Once addressing is completed, the addresses will be returned so that they may be placed on the mylar prior to recording.
3. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. A fee of $10 per lot/tract addressed, payable to Pikes Peak Regional Building Department will be due at the time of mylar review.
4. Provide a copy of the final recorded plat to Enumerations. Approval of any plans submitted for this development will be pending receipt in our office of a copy of the final recorded plat.

Colorado Geological Survey review of the submittal for Winsome Filing No. 2 Final Plat SF2115 (Amy Crandall, P.E., acrandall@mines.edu):

With this referral, we received a Letter of Intent (N.E.S., Inc., February 2021); Final Plat (Edward-James Surveying, Inc., February 18, 2021); Construction Documents (Kimley-Horn and Associates, Inc., January 8, 2021); and Soils, Geology, and Geologic Hazard Study (Entech Engineering, Inc., January 26, 2021). I understand from the referral documents that the final plat for Filing No. 2 comprises 61 residential lots, one commercial lot, and two tracts on 254 acres.

Entech’s Engineering Geology/Geology Map (figure 6) separates Filing No. 2 into the following: seasonal shallow groundwater area (sw), potentially seasonal shallow groundwater area (psw), floodplain (fp), and flowing water (w). As noted on page 9 of Entech’s report, “The floodplain areas have been designated as open space/drainage easements and/or can be avoided by construction and is located outside of the Filing No. 2 development.” Regarding seasonal and potentially seasonal shallow groundwater, Entech states (page 9), “In these areas, we would anticipate the potential for periodically high subsurface moisture conditions and possible frost heave potential.” Also, “These areas lie within low-lying areas along the drainage in the central and eastern portions of Filing No. 2 and in the low-lying areas and minor drainages across the site.” The seasonal shallow groundwater areas and potentially seasonal shallow groundwater areas (as indicated in Entech’s figure 6) are associated with drainage easements on sheets 2 through 7 of the final plat. CGS agrees with Entech (page 9), “These areas can likely be avoided or properly mitigated by development.” CGS also agrees with Entech that the potential for frost heave exists at this site and with their recommendation that “Foundations must have a minimum 30-inch depth for frost protection.”

Entech makes appropriate preliminary recommendations for mitigating the site’s potential development constraints. Provided Entech’s recommendations are adhered to, drainage easements are avoided or properly mitigated during construction, and lot-specific investigations and analyses are conducted, CGS has no objection to final plat approval for Filing No. 2.
