Airport staff recommends no objection with the following conditions:

• Avigation Easement: An avigation easement is requested or provide proof of previous recording (book/page or reception number) for development plan/plat.

• Airport Acknowledgement: Upon accepting residency within Haven Valley, all adult residents and occupants shall be required to sign a notice in which the tenant acknowledges that Haven Valley lies within an Airport Overlay Zone and is located less than 2.5 miles from Colorado Springs Municipal Airport and may, at times (24 hours per day), experience noise and other activities and operations associated with aircraft and the Airport.

• FAA Form 7460-1: If use of equipment (permanent or temporary) will exceed 100 feet above ground level in height at this site, the applicant is to file an airspace evaluation case with the Federal Aviation Administration (FAA) and provide the results to the Airport before the commencement of construction activities. The site does not contain steep slopes or mapped floodplains, nor is it exposed to any geologic hazards that preclude the proposed development. As noted on p. 4 of CTL’s report (Geologic Hazard Evaluation and Preliminary Geotechnical Investigation (CTL Thompson, Inc. (CTL), Revised April 5, 2021), “Conditions we identified that may pose hazards or constraints to development include existing undocumented fill.” Also, “We believe these conditions can be mitigated with engineering design and construction methods commonly employed in this area.” CGS agrees with CTL (p. 5) that “Undocumented fill should be removed and reworked or replaced” and “Design-level geotechnical studies should be undertaken to confirm the presence of fill and depths of fill and to provide recommendations for reworking.” CTL’s characterization of the geologic hazards and constraints associated with the site is valid. Provided CTL’s recommendations are adhered to, and design-level geotechnical studies are performed, CGS has no objection to approval of the proposed residential use and density.

• Street names have been approved, Enumerations has the list of approved street names from E-9-1-1
• Provide a 100 scale copy or larger of the entire APPROVED development plan (d.p.) to this department so that addressing can be assigned. Once received, the development plan will be placed on a list to be addressed. Development plans that are not yet approved may be addressed, however additional plan review fees will accrue if changes are made to the D.P. after initial addressing.
• For assignment of addressing for lots and tracts, place addressing marker (xxx) where they are intended to be utilized. Addressing marker for lots should be front door.

With this referral, CGS received a request to provide Review Comments (Email dated May 13, 2021); Letter of Intent (N.E.S., Inc., May 2021); Planned Unit Development and Preliminary Plan (N.E.S., Inc., April 30, 2021); Letter of Intent (Matrix Design Group, April 19, 2021); Geologic Hazard Evaluation and Due Diligence Geotechnical Investigation (CTL Thompson, Inc. (CTL), Revised March 30, 2021); and other documents.

I understand this planned unit development and preliminary plan referral consists of 98 single-family units on approximately 11.76 acres located at Alturas Drive and Cable Lane.

The site does not contain steep slopes or mapped floodplains, nor is it exposed to any geologic hazards that preclude the proposed development. The existing Fountain Mutual Irrigation Co. (FMIC) and Fountain Mutual Metro District (FMMD) canal system lies to the north of the proposed Haven Valley PUD development plan located south of the intersection of Alturas and Cable Lane. The existing FMIC/FMMD canal system was re-constructed back in 1999 as the "Super Ditch" to carry additional storm water flows from the intersection of Hancock Expressway (Main Street) to the Windmill Gulch natural drainageway where the excess drainage flows are discharged into this natural drainage basin by means of a drainage structure.

Due to the fact that this "Super Ditch" not only carries normal irrigation water for FMIC throughout the year but additional storm water flows for FMMD during runoff events anytime throughout the year creates the potential for over topping of the canal with excess storm water from the canal onto this proposed development project due to its topographic location below the canal. In addition, as part of the ditch operation, water is conveyed across numerous properties to provide irrigation and augmentation water to FMIC shareholders. As a natural phenomenon all ditches by necessity seep water along their route, as the FMIC ditch has done due to the character of the land through which the ditch passes and simply as a necessary result of the historical operations of the ditch. FMIC shall not be liable to any property owner as a result of the ditch seepage from the FMIC ditch as long as FMIC continues to maintain and operate the FMIC ditch in accordance with the requirements of Colorado law as applied in light of historical operations of the ditch. FMIC shall have no obligations to line or encase the FMIC ditch to prevent seepage, but may do so as part of its easement rights.

FMIC takes no further exception to the proposed PUD for this proposed development project.
