The pergola is existing so you need to add that information to the letter of intent. When you hired the contractor, did you believe that they went through the process to get it permitted through Pike's Peak Regional Building before it was constructed? If so, please describe that in the letter of intent. You might also mention how many others in the neighborhood have similar attached pergolas.

Add something into the letter that mentions the 10' rear setback is a requirement of the Courtyards at Woodmen Hills West 1A (PUD-10-002). For example, change the last sentences of the background to read similarly to: I was advised the denial was based on the fact that the rear setback required by the Courtyards at Woodmen Hills West 1A (PUD-10-002) is 10'. The distance between the property line and the back of my home is 14', therefore the 8' wide pergola encroaches into the rear setback by 4 feet.

Verify the dimensions on the width of the pergola. The site plan attached has a label indicating total square footage of 128' (8 feet x 16 feet) but the actual label on the drawing shows it as 7 feet wide x 16 feet long. We need an accurate measurement so we can state whether the setback reduction requested is 6 feet (8' wide pergola) or 7 feet (7' feet wide pergola).
