The El Paso Land Development Code has criteria in our code that must be met to make a determination of non-conformity for lot sizes that are beneath the minimum for the zoning district. In this case, the required lot size for the RR-5 zoning district is 5 acres and the size of the lot you are considering 11,100 Square feet. To be considered legally nonconforming, the lot must be able to accommodate well and septic and be at least one acre in size. The lot you are considering does not meet that criteria so we wanted to reach out to let you know prior to completing the administrative determination. To build on this lot, you would have to go to the Board of Adjustment and request and get approved for a variance for the minimum lot size. In conjunction with that, you could request a dimensional variance for the setbacks. The fee for the variance request is $1037.00 and there is not a guarantee of approval, it would be up to the Board of Adjustment and you would have to make a presentation that justified the request. You would not be able to get approval of a site plan or building permit on a non-conforming lot unless a variance was granted. 7/8/2020 10:35:01 AM
