Lot 4a was previously shown with a large area of build-able area. Now the current grading and stormwater management indicates that lot to be mostly encumbered by steep slopes and a stormwater BMP, and the forthcoming BMP easement. Typically lots that do not have buildable area are platted as tracts. This is currently platted as a lot. LDC Section 7.1.4(A) indicates that no unusable lots, tracts, or parcels may be created. Is there a different way to configure to ensure some build able area with access remains for Lot 4A? Or have you considered a plat amendment to re-designate as a tract? 7/30/2020 4:35:26 PM

- Geotech report with recommendations for the foundation preparation and embankment construction of the permanent detention facility.

This application proposed the construction of a water quality pond on Lot 4A to capture runoff from Lots 1A, 2A, and 3A. The application documents state that no further use of or construction on Lot 4A will occur in the future. It is unclear whether ongoing maintenance responsibility for the pond is intended to be that of the owner of Lot 4A or of all 4 lots in the subdivision.

It is my recommendation that a property owners' association be formed by, or that covenants be drafted for, all properties within the subdivision to provide an enforceable mechanism for all lot owners to contribute to funding maintenance and repair of the facility. Please work with an attorney or other appropriate professional to explore your options.
