Regarding a request for approval of an amendment to a PUD development plan, Enumerations has the following comments:

1. It appears that the space labeled on the plan as personal training will be a separate tenant space with no connection to the brewery space. If that is the case, Then each tenant space will need to be assigned a suite number.

Change in Water Use:

The original subdivision approval for Rolling Thunder allowed for 5 AF/year for Commercial Use and 3 AF/year for irrigation to be shared between all 14 lots in the subdivision. Divided out equally, because specific allotments were not assigned to each individual lot, that would allow approximately 0.357 AF/year for commercial use and 0.214 AF/year for irrigation for Lot 1.

The proposed water use specified in the commitment letter from Falcon Highlands estimates that the use for the existing building will be 0.665 acre feet/year with no allocation specified for irrigation.

Section 8.4.7(E) discusses substantial change in water supply and indicated that a substantial change in water supply requires compliance with Section 8.4.7. BoCC approval shall be required for a substantial change in water use and additional documents shall be required for next submittal. Triggers for substantial water supply that are listed that apply to this site include:

- a change in the subdivision which would result in an increase in the annual water demand exceeding 10%.

The proposed usage of 0.665 AF/year is approximately a 53.68% increase in water compared to the previous allocation of for Lot 1 for inside use. If this use is allowed to have more than the other lots, because water was allocated equally, it reduces the ability of the other lots to develop into uses that require more water than they may currently be using up to the amount specified for each lot in the subdivision. We have another application in process that is also having to deal with a change in water supply at this time.
