1. The ROW established by the 1917 resolution cannot be vacated unless the County Engineer authorizes such vacation in writing, through an email or otherwise.
2. The access easement established by the 2000 deed benefits the property owners to the east of the Applicant's property, one of which is El Paso County. Applicant must determine, through title work or otherwise, who the beneficiaries are of that connection to Vollmer Road, and such beneficiaries must sign the plat or provide written ratification of the plat. For El Paso County, authorization in writing, through an email or otherwise, from the Community Services Department Director must be obtained.
3. The new Access Easement and Agreement must be recorded with the plat, so it must convey an easement from the current owners, as owners of Lot 1, to themselves as owners of Lots 2 and 3. I also recommend that additional provisions be included that outline how the lot owners will decide if and when maintenance or improvements need to occur, who will contract for them, and how funding from the other lot owners will be provided.

Applicant - please provide the following so the County Attorney's Office is able to complete their review of water sufficiency:
1. A deed conveying Dawson water rights from the Peter Spahn Investment Trust to the Katherine F. Spahn Trust Revocable Trust. The water rights were decreed in the name of the Peter Spahn Trust, and the deed provided by the applicant is from the Katherine Spahn Trust to the applicants.
2. The Water Resources Report needs some updating to reflect the change from 4 lots to 3 lots.
a. In §1.1, change “four lots” to “three lots”
b. In §2.1, the breakdown of the water demand does not match that set forth in the WSIS. These 2 documents must be reconciled.
c. In §3.5, change “additional three” to “additional two”
d. In §5.1, change 4.00 A-F to 3.00 A-F
3. Applicant’s must obtain approval of an amended replacement plan that reflects the intent to build 3 wells on 3 lots. The plan does not need to be amended before I’ll complete my review, but it must be done prior to recording the plat.

CGS previously reviewed this submittal on 7/28/20. Our pervious comments are still valid and are repeated here:

The Abeyta Minor Subdivision site does not contain steep slopes or any identified geologic hazards or unusual geotechnical constraints that would preclude the proposed four-lot residential subdivision. The available referral documents include a Soil, Geology, and Geologic Hazard Study, Aztec Residential Subdivision, 13235 Vollmer Road (Entech Engineering, Inc., March 4, 2020, Revised December 10, 2020). Entech's report contains a good description of surface and subsurface conditions based on the results of two borings, two test pits, and laboratory testing, and makes appropriate recommendations regarding site development. Provided Entech's recommendations are adhered to, CGS has no objection to minor subdivision approval.

Plat note 22 is vague. CGS recommends that Entech's two reports, the Soil, Geology, and Geologic Hazard Study, and the OWTS-Wastewater Study, be cited individually, and the El Paso County project file number under which the reports can be located (MS203) should be provided.

The following comments relate to the plat drawing. The access easement will be reviewed in the next review cycle.
1. Please provide a copy of the instrument establishing the "Existing ROW to be abandoned with the plat" on the northern boundary of the subdivision.
2. Please provide a copy of the instrument establishing the ingress & egress easement on Lot 3 purported to be vacated with this plat.
3. The plat notes that an existing 20' MVEA easement across Lots 3 & 4 is to be vacated by plat. The letter from MVEA states that their easements cannot be vacated by plat. Please work with MVEA to determine if the proposed vacation is acceptable and the form in which it must be done.
4. Note 4 of the plat must be corrected. It appears to be a holdover from a Kansas plat.
5. Please change the agency name in Note 9 to El Paso County Public Health.
6. Please change "elevated" to "evaluated" in Note 11.
7. Please change the agency name in note 14 to Department of Public Works.
8. In note 20, please change the name of the Resolution to El Paso County Road Impact Fee

Review I Comments:

Due to the volume and complexity of comments, additional review comments should be expected with the resubmittal. The resubmittal will be treated as a first submittal.

This submittal was made under the assumption that two access points to Vollmer Road were permitted. Per the Early Assistance meeting notes, one access would be permitted and the customer would explore the option of acquiring an access easement through the adjacent county property. An access permit application was received on 9/5/2019, asking for a secondary access permit. Due to no existing access permit being on file, a single primary access permit was issued (AP191248). The resubmittal shall include a single access from Vollmer Road. A secondary access will not meet the criteria of the road classification.

Staff Recommendation: El Paso County Parks staff recommends that the Planning Commission and the Board of County Commissioners include the following conditions when considering and / or approving the Abeyta Minor Subdivision: (1) require fees in lieu of land dedication for regional park purposes in the amount of $1,868 which will be required at the time of recording of the final plat, (2) require the applicant provide a 25-Ft no-build conservation zone along the lot lines bordering the Pineries Open Space, (3) remove the leach field located on the Pineries Open Space that serves Lot 1.

1. Existing lot 1 addressed as 13251 Vollmer Road. Will this lot access from in between proposed lots 3 and 4? If not show location of driveway access. Knowing this information will help to address the proposed lots. Please email me; Amy Vanderbeek amy@pprbd.org
2. Because of the addresses on 52000-00-366, addressing the proposed lots will be challenging and very close together.
3. Addresses are required to be on the plat. Addressing needs to be placed parallel to Vollmer Road, as close to the edge of the lot as possible.
STANDARD ENUMERATIONS COMMENTS-FINAL PLAT:

1. Enumerations will review the mylar prior to plat for address placement, street names and title block.

2. $10.00 per lot & tract platting fee will be due at the time of the review of the mylar (2 addresses per lot & tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. In this case the fee will be for the new addresses only, lots 2,3, 4.

3. A copy of the final recorded plat is required prior to plan submittal for RESIDENTIAL. A copy of the final recorded plat is required prior to approval in the Enumerations department on any COMMERCIAL plan submittal. Amy@pprbd.org

The Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in “Protecting Your Home From Wildfire: Creating Wildfire-Defensible Zones“ FIRE 2012-1 located on the Colorado State Forest Service website.
