The Board of Adjustment is authorized to grant variances from the strict application of any physical requirement of the Code which would result in peculiar and exceptional practical difficulties to, or exceptional and undue hardship upon, the owner of the property. These situations are further described in Land Development Code Section 5.5.2. It is the applicant's responsibility to make the case for approval of their variance in the letter of intent.

In your letter of intent, the Code was referred to but there was no additional information for why the barn structure has to be as large as what is proposed.

Parcels 2.5 acres or greater could have an accessory structure that is up to 2 times the size of the primary residence. If the primary residence was larger, there might not be an issue with the size of the barn. These are the type of arguments that could be used to support your case.

Please revise the letter of intent to justify why the barn structure variance should be approved.

The title commitment references an easement granted to Mountain View Electric Association as described in instrument recorded May 1, 1970 in Book 2341 Page 980 and recorded April 13, 1972 in Book 2841 at Page 317. This easement should be shown on the existing and proposed site plan exhibit.

Easements mentioned on subdivision plat (see attached plat, refer to note 2 describing easements on all side and rear lot lines) should be shown on both the existing and proposed site plan exhibit.
