The Upper Black Squirrel continues to have the same concerns regarding the well permit for this property and the limited water that it is allowed. Our previous comments stand on this Special Use for the Ducy Stables and Riding Academy.
The Upper Black Squirrel could request receipts for the water that is delivered to verify that they are not in violation of their well permit and are in fact purchasing the water and not using their domestic well. We will request that the existing well be metered.

The Upper Black Squirrel Creek GWMD has some concerns as to whether the applicant will have sufficient water for the proposed Horse Riding Academy.

The applicant has a well permit with no.203220 which is for a domestic well with one single family dwelling, 15 gpm, for 0.375 acre-feet annually with 1,000 square foot of lawn and garden irrigation in the Denver aquifer. That is what is allowed in the Carlson subdivision in which the applicant is in. They would be limited in a determination of water rights as well per our rules by their subdivision water supply letter.

The applicant does not have a commercial well and would be in violation of his well permit if he was to use his domestic well for a commercial operation.

There are still items missing on the site plan that are required by planning and engineering. It appears that you are struggling with this submittal item. Would you prefer to schedule a time to meet and go over the requirements individually so you understand what to put on the site plan? Letter of Intent: I think there is some confusion on this item. The letter of intent is different from the adjacent parcel notification although there is some duplication of the information that is included in the letter.

Please take the content from the notification letter sent to the neighbors and modify it (don't delete anything but just add onto that letter) to include the following additional information:

Address this letter to Craig Dossey, Executive Director of Planning and Community Development

Add the PCD File Number: AL-19-016

Please address the approval criteria from the Land Development Code for Special Uses. For your convenience, here are the approval criteria from the code:

In approving a special use, the following criteria may be considered:

• The special use is generally consistent with the applicable Master Plan;

• The special use will be in harmony with the character of the neighborhood, and will generally be compatible with the existing and allowable land uses in the surrounding area;

• The impact of the special use does not overburden or exceed the capacity of public facilities and services, or, in the alternative, the special use application demonstrates that it will provide adequate public facilities in a timely and efficient manner;

• The special use will not create unmitigated traffic congestion or traffic hazards in the surrounding area, and has adequate, legal access;

• The special use will comply with all applicable local, state, and federal laws and regulations regarding air, water, light, or noise pollution;

• The special use will not otherwise be detrimental to the public health, safety and welfare of the present or future residents of El Paso County; and/or

• The special use conforms or will conform to all other applicable County rules, regulations or ordinances.

Please see attached image showing the parcels that should have been notified. It appears you notified some neighbors that did not need notification and omitted others.

For project resubmittal you have to notify all of these parcels. You need to also upload the letter that you sent them detailing the Special Use requested for the site.

Each person listed on the Assessor's site as an owner must be addressed in the letter and on the certified mailing receipts. I typed the names and mailing addresses out on the image attached to further assist you.
