At this time the letter of intent and the invoices have been vetted, and are acceptable as submitted. Drainage reimbursements may not be processed until improvements have been placed into preliminary acceptance. This project has not been placed into preliminary acceptance at this time (although the FAE has been reduced to defect warranty amount) there is a small punch list. Please remediate the punch list and schedule an inspection with David Parkerson so that this project may be placed into preliminary acceptance and the warranty period may begin. At which time the county will complete the reimbursement and take to the Drainage Board and the Board of County Commissioners to establish your credits. Note that these will be conditional credits (which may be used to off set fees, no cash may be reimbursed until such time as the DBPS is completed).

Please provide the engineer's certification for both the bridge and the channel work, the EPC project manager will add an additional slot for you to provide this document.

1. Please clarify the lack of payment for the $20,667.33 as listed on the pay application number 9, invoice number 11284. If identified that this was not paid, please change all requests for reimbursement to reflect this deduction.

2. At this time there is no accepted/approved JCC DBPS. Due to comments from the BOCC when a prior JCC reimbursement request was processed (2006), this reimbursement will be processed and a ‘conditional credit’ will be established. Future fees in this development may be deferred with this conditional credit, however no cash payouts will be made based on this conditional credit until the DBPS is approved. The El Paso County Department of Public Works has appropriated funds for the study and anticipates to award a contract this year.
