Adjacent property notification - I see you revised to add the letter of intent and to notify that one parcel that was not originally notified. the way our system works is the new submittals override old submittals so when you uploaded those new items, it removed the old adjacent property notifications. The site plan exhibit for admin relief should label the required front yard setback and the side yard setback and then also label the proposed reduced setback under the admin relief so it is clear what is being requested. That makes this exhibit a little different than what has been submitted for special use or site plan. Please update. 12/31/2019 8:40:09 AM

Letter of Intent: The wording on the admin relief request portion is confusing. Did you instead mean to say the following? If so, please revise and resubmit the letter of intent.

In order to fit within the constraints set by the minimum side setbacks as set
forth in the El Paso County Land Development Code, a reduction in the
minimum side and front yard setback requirements are requested (not to exceed 20% of any setback requirement). For operational functionality, the building was carefully planned
out by the Owner and Architect in order to provide space for sales, offices, and
storage. Along the northern edge of the site, a reduction to the front yard setback from 50-feet to
40-feet, or 20%, is requested. Along the southern edge of the site, a reduction
from 30-feet to 29.35-feet for the side yard setback, or 2%, is requested.

The El Paso Land Development Code defines front yard as "a yard extending across the width of the lot, parcel, or tract and measured from the front boundary line of the lot, parcel, or tract on which the lot, parcel, or tract fronts or is addressed by to the nearest building. A lot, parcel or tract bordered by roads on both sides shall have two front yards for setback purposes"

Based on this definition a 50' setback would apply to the west property line along Amelia Street and also to the north property line along Terminal Avenue. Administrative relief permits up to a 20% reduction in setback from what is required. With a required setback of 50', the setback could be reduced down to 40' with approval of administrative relief. Anything beyond that will require approval from the Board of Adjustment. Your application proposes reduction down to 24' which would not qualify for administrative relief.

Your options at this point are to redesign the site so that the maximum setback reduction requested is 20% along the north property line (this would be a reduction from a 50' setback down to 40') or to request approval from the Board of Adjustment to reduce the setback down to the 24' shown in the site plan exhibit attached. I have attached the review criteria that the Board of Adjustment would use for deciding whether or not to grant the setback variance for your review. Please let me know how you would like to proceed.
