Review 3: Be advised Road Impact Fee applies to this application for the outdoor RV/trailer storage. Effective on and after January 1, 2020, the obligation to pay Road Impact Fees is triggered by issuance of a Land Use Approval. For uses that require multiple Land Use Approvals, the obligation is triggered by the final Land Use Approval required. Road impact fee would be due with this special use if a site development plan application is not required or else the fee is due with the site development plan application.

For RV Storage, this use is similar to a mini-storage category. Instead of gross square feet, the number of parking spaces is used.

Letter of Intent: I see that you have removed the request for waiver of the 50' setback from property line for the storage area. However, that area is still shown the same on the site plan (right up next to the property line.) If you keep the storage there, you need to request the waiver but we do not anticipate that the Planning Commission or the Board of County Commissioners would be receptive to that waiver because, in a recent work session, home occupations were discussed and the need to appropriately mitigate and screen were topics supported by the Board. 5/13/2020 4:09:05 PM

Repeat Comment: The site plan is still not up to standard. I will be reaching out in the next few days to see if I can assist you with that part of the process so we can continue to move this application forward.

The site plan should be more detailed and show all of the following items:

North arrow.

Property line of the parcel.

All existing structures within the property lines of the parcel.

Surrounding parcels around the site and their owners and parcel numbers.

Driveways.

Setbacks for the RR-5 zoning district: 25 feet front yard, 25 feet rear yard, and 25 feet side yard

The RV, boat, and trailer storage shall be set back a minimum of 50 feet from all property lines per LDC Section 5.2.29(B)(5)(a). Please show the proposed location of the storage area in compliance with this setback requirement.

Because the proposed area of outside storage is greater than 5,000 SF, you must screen the outside storage area per the provisions of LDC Section 5.2.37(B)(2). Show the proposed screening on the site plan exhibit for next submittal. Note: chainlink fencing with fabric or slats is not considered solid fencing.

Please check with the assessor regarding your proposed request. In some cases parcels that have ag exemptions for tax purposes can lose that exemption if they establish a commercial use on the site. The Assessor's office will be a review agency for this project. 10/2/2019 12:48:07 PM

The letter of intent indicated that you wish to request a waiver for the 50' setback from property lines for outside storage associated with a home occupation. We highly discourage you from making that request because that provision is put in place to mitigate the impacts of your home occupation on the surrounding property owners. We do not anticipate that the Planning Commission or the Board of County Commissioners would be receptive to that waiver because, in a recent work session, home occupations were discussed and the need to appropriately mitigate and screen were topics supported by the Board.

If you wish to remove that request, please revise the letter of intent to remove the waiver request.

Additionally, please revise the letter of intent to describe how you comply with the special use approval criteria from the Land Development Code (see attached).

Mineral Rights Certification - It appears the mineral rights certification was filled out and notarized but you did not complete the portion indicating whether there is or is not a mineral estate owner.

To determine whether there is or is not, you can contact the El Paso County Clerk and Recorder's office or you can speak with the issuer of your title commitment as they did the research for that to complete your title commitment.

Please complete the mineral rights certification indicating whether there "is" or "is not" a mineral estate owner other than you. If there is a mineral estate owner, you need to make efforts to research them or their descendants and send them the same letter you send to the adjacent property owners. If you cannot locate the mineral estate owner, you need to write a letter to detail the efforts you made to do so.
