Schedule B Section II Number 8 of the title commitment indicates there are severed mineral rights for this parcel. This conflicts with the mineral rights certification that indicates there are not mineral rights owners other than the property owner.

1. If there are mineral rights owners, you are required to research them and contact them (or their descendants) to notify them of the proposed development via letter, similarly to how you notified the adjacent parcel owners or the proposed development. If you are unable to located them, you need to write a letter indicating the efforts you made to locate them and/or their descendants and that you were unable to do so.

2. Please modify and re-notarize the mineral rights certification to indicate there are mineral rights owners.

3. Upload the notification letter to the mineral rights estate owner(s) along with the revised mineral rights certification in the same document. Just add the notification letters on subsequent sheets after the mineral rights certification form.

Letter of Intent: It appears you uploaded comment response letter in place of the letter of intent. I will add an upload space for comment response letter for this submittal.

Because this is an application for special use, you need to address the Land Development Approval Criteria for the special use in your letter of intent. I have attached those to this comment.

The site plan reflects acreage of 624.18. The letter of intent reflects 937 acres. Please address this discrepancy so both are consistent.

Indicate the maximum number of carriers this tower will accommodate.

Colocation Analysis - It is clear there is a gap in coverage but the coverage maps provided do not show what the coverage would be if you collocate on any or all of those existing towers within the target range. Per the Land Development Code, the applicant shall demonstrate that due to physical constraints, or economic or technological infeasibility, no such location or co-location is available.

Also indicate the proposed number of carriers that this tower can accommodate on the colocation analysis letter.

Site Plan:

For the special use application add PCD File Number to the Site Plan Coversheet: PCD File Number: AL-19-021

Project Description section on the coversheet of the site plan: Indicate whether or not the tower will have lighting.

On the site plan (upper drawing on sheet 1) please provide a note indicating the distance to the nearest residential use from the proposed tower location. The Land Development Code sets forth setbacks for the tower in accordance to the distance from nearby residential uses and/or zoning districts.

Label the diameter of the proposed Microwave Antennae. Per Land Development Code, microwave antennae cannot exceed 4' diameter.

Provide a detail for the perimeter fencing of the lease area. Note that the Land Development Code requires that all accessory equipment shall be 100% screened from view. All equipment shelters shall be located within the lease area for the tower. No equipment storage shelter shall exceed 15 feet in heights. Equipment storage shelters shall be grouped as closely together as practical, so as to minimize impact on adjoining properties. We will be looking for fencing that provides 100% screening for the ground level accessory equipment and equipment shelter enclosures that do not exceed 15 feet in height.

Engineering has the following comments:
-In the letter of intent, discuss the anticipated traffic generated by the proposed tower.
-A driveway access permit must be obtained for the proposed access onto Goldfield Road.

Staff recommends utilizing appropriate erosion and Stormwater control measures during construction to prevent sediment runoff.
