Changes to License Agreement are attached. Though they appear extensive, they are primarily wording and formatting changes to comply with the most recent version of this document.

Please note that assignment of this document requires approval by the Board of County Commissioners. If COLA, LLC is not the party ultimately responsible for maintenance of the Improvements, I recommend adding the party that will be, such as an HOA or special district. I can assist with drafting the appropriate changes to the document if desired.

• LOI indicates 605 lots.
• District letter commits to 785 lots
• Water Supply Information Summary indicates 561 lots
• Water Resources Report includes WSIS indicating 605 lots, with District letter committing to 785 lots
According to the SEO letter, there are 605 lots and they reference a District letter dated 11/19/19 committing to 211.75 acre-feet of water on 605 lots. Please confirm if 605 lots is the correct number and if so, upload a copy of the 11/19/19 District letter. Thank you!

Regarding a request for approval of a PUD development plan for Trails at Aspen Ridge, Enumerations has the following comments:

1. Enumerations had previously commented on the need to have specific construction requirements for Lots 377-491 based on less than 5 foot setbacks. The applicants response was that the space between buildings is 10 feet so these requirements do not apply. After discussion with RBD construction plan reviewers, it has been clarified that the setback requirement for fire rated walls etc., is measured from the structure to the lot line, and not by the distance between structures. Therefore, the fire rated requirement is in effect. The applicant should contact RBD construction review coordinator Shelly Dicker if they wish to discuss this requirement.

Please note that the BoCC approved revisions to the LDC to allow for administrative final plats provided certain findings could be made at the preliminary plan stage. If you wish to file administrative final plats in the future please review the amendments and add the additional criteria to your letter of intent and specifically request that administrative final plats be authorized. These revisions have not been codified yet an are viewable on our website.
1. Note that due to proposed landscaping being within the ROW, a landscaping within the ROW agreement will be required with future filings.

Regarding a request for approval of a site development plan for Trails at Aspen Ridge, Enumerations has the following comments:

1. Enumerations has requested a copy of this development to use for addressing. The developer provided one, however, the copy that was sent included contour lines throughout the development which rendered it useless as a working copy. The applicant should provide a copy without the contour lines for us to use to ensure consistent addressing throughout all phases of this development.
2. Side yard setbacks of less than 5 feet trigger fire rating building requirements. Contact RBD construction plan reviewers to discuss what will be required to comply with building code on all lots with less than a 5 foot side yard setback.
3. Enumerations will have more comments as each phase is submitted for review.

1. Please keep in mind that a 1041 permit may be required for the water/wastewater system infrastructure (pump station). Prior to construction of those improvements, an administrative determination should be filed for an official determination.
2. PCD intends to request the BoCC amend the LDC to allow for administrative final plats. If approved, administrative final plats could only be permitted if a water finding was made at the preliminary plan stage and if those public improvements/infrastructure were identified at the preliminary plan stage.

Would appreciate the contractor submitting a separate word document with all proposed street names and their type (public or private) associated with this project. This would be in addition to the streets name's indicated location on the plat drawing. This will help to insure that proposed street names are not inadvertently overlooked during the approval process.

Regarding a request for approval of a PUD development plan for Trails at Aspen Ridge, Enumerations has the following comments:

1. Enumerations will make comments as appropriate as each phase is submitted. Enumerations requests that a large format copy of the entire development be provided so that addressing can be provided consistently and correctly.
2. When addressing the rear loaded lots (Lots 377-491), Enumerations may require plat notes indicating the location of address placement on the homes. Some lots may have the address posted on the rear only, front only, or on both sides in order to facilitate wayfinding and emergency response and to limit confusion. Enumerations will provide specific direction for placement at the time of addressing.
3. The side setbacks for Lots 377-491 will trigger construction requirements for fire rated walls. The applicant should contact Regional Building construction plan reviewers for information on what specifically will be required for these lots.

1. Not all adjacent property owners were notified. Please review the surrounding ownership and send certified mail to those missing parties- this includes governmental agencies.
2. The water and wastewater commitment letters are from 2017. Please provide new commitments for the proposed development.
3. The proposed phasing would result in more than 25 lots being off of a dead end road. Please revise.
4. The maintenance plan does not specify who is responsible. Please revise.
5. The soils and geology identifies lots within areas that may experience seasonal water. The soils and geology report identifies that in these areas a perimeter drain may be necessary. No notes exist to indicate the need for perimeter drains.
6.Add match sheet references to all PUDSP pages.
7. Please add the PUD modification(s) as a separate subheader and request in the letter of intent with justification based upon the LDC criteria. Similarly,
