Please provide Declaration of Covenants, Conditions, and Restrictions as referenced in the County Attorney's findings that were issued on December 6, 2019. These covenants should be referenced on the plat with a note.

Please provide copies of form deeds that will be used to transfer water rights to subsequent property owners so we can review those prior to time to record those deeds. If you need an example of what these might look like, let me know and I can ask if the county attorney's office has a sample to share. These were referenced in Item E in the County Attorney's findings letter issued December 6.

Prior to recording the minor subdivision plat, the applicant shall provide proof of permitting the existing well pursuant to the augmentation plan, that a new well permit has been obtained or that the existing well has been plugged and abandoned.

The Pony Tracks II site is not exposed to any geologic hazards or unusual geotechnical constraints that would preclude the proposed two-lot residential subdivision. Colorado Geological Survey therefore has no objection to plat approval.

Entech's Soil, Geology, Geologic Hazard, and Wastewater Study, Pony Tracks Subdivision Filing No. 2 (5/24/2019) provides a valid description of surface and subsurface conditions, soil and bedrock engineering properties, and potential development constraints. These include loose, possibly compressible soils, shallow (probably perched) groundwater and, although not encountered in Entech's two borings, layers and lenses of expansive clay soils and claystone bedrock. Entech's geotechnical recommendations are valid.
