Comments from the County Attorney's Office related to County Attorney letter dated May 2, 2019 are as follows:

1. For Requirement B, Applicant clarified the status of the Well Permit No. 304551—that the well has been drilled. It will be Applicant’s responsibility to make sure that use of this well complies with the Augmentation Plan.

2. For Requirement C, the new revised WSIS is okay.

3. For Requirements A and D-G, County Attorney requirements still stand. Applicant’s statement that “[d]raft water deeds and covenants have been created and will be recorded post final plat” does not meet the requirements. The County Attorney's Office needs to see the draft Covenants. Deed restrictions, and deeds conveying water BEFORE the final plat is recorded.

We previously made the comment that a proposed primary regional trail corridor appears to exist along the southern border of Tract A of Timber Ridge West on the county master plan but is not shown on this plat. Applicant's response is that "It has been determined that this trail is not part of Timber Ridge West". How was that determined? That regional trail corridor is an alternate to the regional trail that would have extended north of Arroyo Lane through the Sand Creek Corridor in The Retreat at Timber Ridge before that acreage was removed from The Retreat at Timber Ridge development and sold separately If an alternate regional trail corridor connecting to Black Forest Section 16 will now be needed, the corridor along the southern border of Tract A of Timber Ridge West could very well be necessary to facilitate regional trail connections west of Vollmer Road to Black Forest Section 16 and the Pineries Open Space.

Regarding a request for approval of a final plat for Timber Ridge West, Enumerations has the following comments:

1. 911 has requested that the proposed access for Lots 1 & 2 be a named private road. Once the road name has been submitted and accepted by 911, the applicant should contact Enumerations to request addresses for these lots to appear on the mylar. The address of 10620 Vollmer Rd. should appear in the appropriate location on Lot 3.



Floodplain has no further comment.

2/25/2019: Recommend that the access street off Vollmer Road be given a street name. Since this intended to be a private road the street suffix should end in: Grove, Heights, Point, or View.
Permeate signage should then be placed at the driveway access for Lots 1&2.

This submittal requires a Final rather than a Preliminary Drainage report. See El Paso County criteria for requirements.
The proposed application will require a deviation request to address the access point(s).

Regarding a request for approval of a final plat for Timber Ridge West minor subdivision, Enumerations has the following comments:

1. There is an existing residence addressed as 10620 Vollmer Rd. located on what is shown as Tract A on the plat. Tracts are used for purposes such as buffers, parks, easements, etc. This should be designated as a lot, not a tract.
2. Per regional building code, addresses must appear on plats. The applicant should contact Enumerations to establish addresses for Lots 1 & 2 to be placed on the plat. The address of 10620 Vollmer Rd. should appear on what is currently designated Tract A (see comment 1)
3. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. A $10 per lot addressing fee will be due at the time of mylar review. No fee will be due for re-designated Tract A since the address is existing.
4. The letter of intent should more clearly state the plans for this development instead of being an overview of Timber Ridge as a whole.


Floodplain has the following comments;

1. New FEMA FIRM panels recently became effective in El Paso County. The floodplain statement should be updated to show the new information: panel 08041C0535G with an effective date of December 7, 2018

It has been brought to staff's attention that there is a home on the piece of ground depicted as a tract. This will need to be platted as a lot. Building permits may not be obtained on parcels less than 35 acres. Staff has consulted with the Planning Manager on the matter for further clarification. The well will serve 3 lots not two. Please upload the corrected documents for the LOI, States Water Summary Form. Future subdivision of this larger lot will be a vacation and replat. 1/29/2019 9:13:31 AM

Thank you for the opportunity to review this project. Goal A.4.3.A. of the Trails Addendum to the Black Forest Preservation Plan is for provision of neighborhood trails in new developments that can ultimately connect to the regional trail system. The county regional trail route is at the intersection of Vollmer Road and Arroya Lane.on the east side of Vollmer Road. There is also a planned north-south bicycle route along Vollmer. A proposed primary regional trail corridor appears to exist along the southern border of Tract A of Timber Ridge West on the county master plan but is not shown on this plat.

The letter of intent for this application was copied from the PUD. Provide a letter of intent for this minor subdivision request; provide compliance with the Code's approval criteria.
The waste water study is not specific to this application and will need to be provided. If the intent was to combine a geology and soils with the waste water study as indicated at the EA, provide a soils and geology report that meets the waste water treatment report requirements of the Code and the Health Department. The soils and & geology study provided with the development across the street does not provide specifics for the land west of Vollmer. Both a geology and soils and a waste water treatment report (Code 8.4.8 and 8.4.9) must be completed for this application to include the land described in the legal description for this application. The reports may be combined with this minor subdivision, but must be completed by a licensed professional.
The legal description in the title work does not match the plats legal- please verify that both are accurate.
The plat has many errors. see redlines
The drainage report is title preliminary and is labeled for another subdivision.
A full review will be provided after corrections are made. Staff will resend the application to the review agencies.

The Black Forest Land Use Committee finds this proposal very confusing and disjointed in many ways. The letter of intent is inaccurate and conflicted and the plat drawings are unclear.

1. The title, "Timber Ridge West," suggests the proposal is for the 29 acres owned by Jacob DeCoto west of Vollmer and north of the Arroya alignment. Earlier LOIs for the Retreat have clearly stated that the 29-acre parcel would be developed in the future and would have no more than 7 lots which would be an average of 4+ acres/lot and would conform with the Preservation Plan. However, the description at the top of the EDARP page says it is a minor subdivision for 2 lots of about 3+ acres each SW of that intersection and calls it 36 acres.

2. The two lots SW of the Vollmer/Arroya intersection are already part of the Retreat at TimberRidge PUD and preliminary plan and it seems to us that this application should be for a final plat for those two lots, if anything. The two lots were part of Phase 2 of the Retreat preliminary plan so separating them out is a change from the phasing if that was intended.

3. The plat drawings show the two lots as well as the 29-acre larger parcel owned by Jacob DeCoto but doesn't highlight or point out the two lots in this application.

4. The Letter of Intent seems to be the same one used for the larger Retreat at TimberRidge that has all sorts of references to the Retreat with 212 lots on 263 acres. The LOI refers to a zone change as part of this application, trails, open space, urban lots, central water and sewer and other things that have no relation to the two lots that seem to be the focus of this application.

5. In short, Terra Nova Engineering has done a terrible job of preparing this LOI, drawing and application.

6. The Land Use Committee will provide no further comments until the confusion in this application is resolved.
