Please Modify the light pole design to be compliant with the Land Development Code. The height limit for fixtures is 20-feet. A variance would be required to exceed the height as identified in Chapter 6, 6.2.3 Section of the Land Development Code. A hardship would need to be identified to the Board of Adjustment. An EA ($427.00) is required to initiate that application. a non-refundable fee of $1050.00 is required for a BOA hearing, which meets once a month. Staff does not support the height variance due to the residential development to the west, north, and east. Please modify all plans, including site development plans to be compliant with the Code. Please work with future lot owners to require Code compliance.

The Upper Black Squirrel Creek GWMD does not have any issues with the plan but does have concerns regarding the detention ponds and holding water that is recharge to the alluvial aquifer of the Upper Black Squirrel Basin. How will this water be released for recharge and how do you avoid holding water for over 72 hours which is what is allowed? Will there be under-drains? If yes, the district would like to see a map of where those under-drains will be and where the water will be going to as that is also recharge to the basin. 8/19/2020 3:11:30 PM

CSU did not recommend approval on this plat as there are several issues with the easements not closing. However, the Plat has already been recorded and any further comments by Colorado Springs Utilities will not have any bearing as the plat cannot be changed. Colorado Springs Utilities does need any further review for this plat. Please let me know if there are questions.

Please add the following block statement to the Construction Drawings: Please add the following easement note: All easements shown or dedicated hereon for public utility purposes shall be subject to those terms and conditions as specified in the instrument recorded at Reception No. 212112548 of the records of El Paso County, Colorado. All other easements or interests of records affecting any of the platted property depicted hereon shall not be affected and shall remain in full force and effect.

Provide a sheet two for the round-a-bout landscape details only to address the sight distance in the ECM.
A FAE shall be included for these round-a-bout landscape improvements associated with the subdivision construction drawings. The remaining landscaping does NOT need to be included in the FAE for the overall development because it will be included at the individual lot development phase.
Please note that this landscape plan does not meet the Chapter six Code requirements. It does establish a base line design for consistency throughout the commercial center development. At the time of the site development plan, each lot will be required to be in compliance with the Code.

The utility plans are not complete, the water line must loop on the west and north side of Lot 2 with additional fire hydrants and sewer must be extended to serve Lot 1 & 2. Regarding the ROW & Drainage Easements:
1. It has long been the County's policy to require fee simple title rather than easements for ROW. Please confirm with the County Engineer that an easement is acceptable.
2. The County is prohibited by law from indemnifying other entities. The last sentence of the first paragraph of Section 3 and all of Section 4 must be deleted.
3. Please add a provision to each document that the Grantor will make no use of the Easement area, nor grant any other interest in the property, that would interfere with the Grantee's use of the easement.
4. In paragraph 2 of Section 3, please clarify that any existing fencing that would interfere with the Grantee's Improvements will be built adjacent to or as near as practicable to such Improvements.

Regarding a request for approval of a final plat for Falcon Marketplace, Enumerations has the following comments:

1. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. A $10 per lot/tract addressed fee will be due at the time of mylar review.
2. Provide a copy of the final recorded plat for our records. Enumerations will not approve any building plans submitted without a copy of the final recorded plat in our records.


Floodplain has the following comments:

1. New FEMA FIRM panels recently became effective for El Paso County. The floodplain statement should be updated to show the new information: panel 08041C0575G with an effective date of December 7, 2018.
2. Per Regional Building Code, this plat cannot be recorded until the effective date of the LOMR removing this parcel from the floodplain.
