If variance of use is approved, prior to establishment of the proposed use a site development plan will be required. This will require compliance with all items set forth in Chapter 6 of the Land Development Code. Reviewing the site plan exhibit for the variance of use, I see several items that will require revision at time of site plan:

Outside storage of any materials or vehicles shall require screening per LDC Section 5.2.37

Landscaping per LDC Section 6.2.2 including roadway landscaping, parking lot landscaping, parking lot screening, Required buffer and screen areas, outside storage area landscaping requirements, refuse area screening, loading dock and other vehicle area (fuel areas and vehicle repair areas) screening, and Internal landscaping.

Parking lots with more than 15 spaces are required to provide planting islands at a rate of one island per 15 parking spaces. The planting islands should be, at minimum, the dimension of a parking space.

One parking space per 750 square feet of building area. Parking that is excessive to that requirement shall be justified with evidence of need.

Compliance with minimum disabled parking space requirements.

Truck loading and turnaround areas.

Bicycle parking

If the variance of use is approved, it is going to carry the condition that a site plan meeting all requirements of the Land Development Code shall be approved prior to initiating the use. If you get to that point and cannot comply with the code requirements of the LDC, a revision to the variance of use would be required that could drastically extend your timeline for establishment of the use. Though this should not be considered an all inclusive list of items that will be required at site plan, I wanted to bring these to your attention in case you want to modify the variance of use exhibit to ensure that you will be able to comply with these items at time of site plan submittal.

Regarding a request for approval of a use variance for Pete Lien and Sons concrete plant, Enumerations has the following comments:

1. Enumerations has no objection to the use variance.
2. This parcel does not currently have an address assigned. The applicant should contact Enumerations to establish an address for the property.



Floodplain has the following comments:

1. The site plan shows the proposed concrete plant to be well outside of the floodplain areas which are present on the parcel. If the design of the site should change in such a way that it encroaches on the floodplain areas, the applicant should contact Floodplain Administrator Keith Curtis to discuss compliance with floodplain regulations.

The Upper Black Squirrel Creek GWMD Board of Director's reviewed the Pete Lien & Son Batch Plant and have concerns regarding the water rights for this property. The District has not seen anything from the State on this and are unaware and were not provided determination of water rights for this property by either the State or the County. It is also of concern whether they have an adequate water supply for this operation.

The District requests future submittals on this plan.
