Hanover Fire Department has no objection over this project as it stands if the impact to the roads can be address. We do acknowledge that there is a dispute between the HOA and Mr. Meisman over this project and the conversations or negotiations have broken down. Mr. Meisman acknowledge through the letter of intent that the HOA is responsible for maintaining the roads that his trucks and employees will be using to access his property throughout the week. In his letter he states he has a legal right to use those roads and the meetings that we have attended that was never been in dispute. What has been in contention between the 2 groups is running a trucking business off his property and the damage it will cause to the roads. The pictures that we have provided previously are from the 2 of the 3 roads that these trucks could use. The damages in these pictures are from the residents that was caused after a rainstorm. We would encourage that if this project is approve that there has to be an agreement in place on the repairs needed due to the damages that these trucks will cause furthermore we would hope that they are kept to a primary and secondary roads so the damages are limited to 2 roads. 6/8/2020 4:23:41 PM

Site Plan Comments:

Label the location of the outside storage for vehicles and equipment on the site plan.

For the area of outside storage, provide screening pursuant to LDC Section 6.2.2 (F).

Provide a HC accessible access aisle as specified in LDC Section 6.2.5 (c) for the HC parking space.

Letter of Intent:

Add PCD File number AL-18-024 to the letter of intent.

The land development code limits the rural home occupation to a maximum of 2 employees, who are not family members or principally employed in a use which is otherwise allowed on the lot or parcel. If you wish to operate outside the scope of a rural home occupation, a variance of use would instead be required.

The letter of intent indicates that a shop/accessory building is proposed. The applicant indicated that is no longer proposed so it should no longer be referenced in the letter of intent. Please revise the letter to match what is currently being proposed for the site.

The applicant came into the office and indicated that he desired to change the plans to reduce proposed disturbance to less than an acre and the remove the proposed shop/accessory building from the project scope. Hanover Fire Department supports the project however we do have some concerns about the truck traffic to and from this address. The roads in Villa Casitas subdivision are the best maintained private roads in our Fire District. The road base is clay with some sand and little gravel. The roads are neither built nor maintained to sustain this type of everyday traffic. The trucks using these roads overtime during the rainy seasons will destroy them making them difficult to access the homes in an emergency situation. We believe that primary and secondary routs should be identified and see what if any maintenance or repairs needs to be conducted first. These roads are maintained by the Villa Casitas home owners associations thru limited funds they collect though monthly dues. We highly encourage that the County seek out comments from the Homeowners Associations Board about this project. Since these roads are private and the associations maintains them they may like to some say on drive way entrance from and to this property onto their road systems.

We have taken pictures after the recent snow storm of the roads. The attached pictures shows what the roads look like after the snow melted and the current residents left for work. The first picture is where the trucks will exit the property onto Avenida Hermosa Vw. The way that it drawn on the map you have the drive way straight out of the property and having them turn onto Avenida Hermosa Vw. The issue is the current road is not wide enough for them to make the turn without causing major damage to the road and ditches. We would like the drive way exit the property at an angle so the trucks have a straight access off and back on to the property from Avenida Hermosa vw with little to no turning required.
We understand from Mt. Meisman has been working with Villa Casitas home owner associations. He has stated he is willing to haul road material in and help them purchase material at his cost as long as the associations pays for the material that is needed to maintain all the roads in that subdivision. He also has stated he is willing to operate the association’s road grader to help keep the roads graded as well. We feel that there needs to be something in writing on any verbal agreements regarding future road maintenance or repairs of the roads that are affected by the new truck traffic.

The lot is sloped towards Calle Pacifico Pt, El Nino Pt and Avenida Hermosa Vw. The runoff from the rain and limited ditches could cause limited flooding to these roads and homes across from this property. Would like some clarification on how the runoff is going to be controlled and the water redirected so there is no adverse impact on surrounding property owners or the roads.

The environment impact as described in the letter of intent talks about storage and disposals petroleum and other products. There is no mention on the quantities that will be stored site. This may be little quantities at first however we would like to have some type of maximum authorized amounts allowed in writing under this special use agreement.
