The Detention Maintenance Agreement provided, recorded in 2008, applies to detention basins on Tract A and Lots 9, 10 and 11, Rolling Thunder Business Park. The drainage report for this project indicates that runoff will flow to an existing pond on Lots 9 & 10. 1. Please definitively state whether the existing water quality control pond has an existing detention maintenance agreement. If so, please provide a copy.

2. If there is no existing detention maintenance agreement for the existing pond, one must be provided for it, along with any other detention or water quality improvement. The agreement must comply with our approved template to be signed by both the property owner and the metro district.

If a detention maintenance agreement for the pond on this site has already been executed and recorded, for example with the final plat, then please upload a copy of that agreement. On Tuesday September 11, 2018 staff conducted a site visit of the existing Peak Gymnastics facility located to the north of the subject parcel in order to gain a better understanding of anticipated traffic and parking needs. Per the Peak Gymnastics website on this date four classes ended at 5:15 and four new class begun at 5:30. Staff observed the following:
5:15- 25 cars in the parking lot
5:20- 15 cars in the parking lot
5:25- 16 cars in the parking lot
5:30- 13 cars in the parking lot
5:35- 19 cars in the parking lot

Based upon observation it did not appear as though parents were dropping their children off and leaving the facility. Some parents did choose to wait in their cars but it did not appear as though they were leaving he parking lot. Based upon the highest number of vehicles observed of 25 spaces, this would be the equivalent of 1 space per 200 sq ft. 1 space per 200 sq ft is what has been approved in the past for gymnastic facilities in unincorporated El Paso County.

Staff also visited Aerials Gymnastics within the City limits located at 3536 Hartsel Dr. This facility is 20,700 sq ft in size. Based upon their website they have the potential for 10 classes to be occurring between 5:40-6:40pm on Tuesdays. Staff arrived at the site at 5:50pm and observed 29 cars in the parking lot. This is equivalent to 1 space per 713 sq ft. The website did not provide enough information for it to be determined if the classes were full, or if all of the available classes were being conducted. The facility is also a part of a larger shopping center development so it is difficult to determine if those in the designated parking area were the only vehicles for the use. Staff does not feel as though this is an accurate depiction of anticipated traffic.

Your existing facility is 5,000 sq ft in size and the new facility is proposed to be 14,800 sq ft in size. If your existing facility were to be tripled in size with the same operation, and based upon observation in the field, we would require 75 parking spaces whereas you are proposing 66. This is a deficiency of 9 parking spaces.

The PCD Director will not approve the alternative parking ratio requested of 1 space per 250 sq ft. The PDC Director will allow for an alternative parking ratio of 1 space per 200 sq ft. This will require the building size to be reduced, or the site to be revised to allow for additional parking.

The PCD Deputy Director requests that the alternative landscape request be submitted via a separate letter that includes additional information pertaining to Section 6.2.5.D.1.a.vi be added. 1. All signs require a sign permit.
2. All proposed improvements must be installed prior to receiving a CO for the building.
3. A driveway permit and ESQCP permit are required. Financial assurance must be submitted prior to the pre-con meeting.
4. The proposed light exceeds the height allowance listed in the PUD.
5. It does not appear as though the building meets the architectural guidelines of the PUD. Please submit proof of approval from the POA.
6. The following note should be added to all site development plans or non-residential site plans, as applicable, prior to PCD approval:
The parties responsible for this plan have familiarized themselves with all current accessibility criteria and specifications and the proposed plan reflects all site elements required by the applicable ADA design standards and guidelines as published by the United States Department of Justice. Approval of this plan by El Paso County does not assure compliance with the ADA or any regulations or guidelines enacted or promulgated under or with respect to such laws.
