Based on the plat drawings this appears to be a request to replat 5 lots (1 commercial & 4 residential) into 7 lots (1 commercial & 6 residential).
1. Both the Colorado Division of Water Resources letter and the 2018 Petrock Letter are based on replatting the existing commercial lot into 2 commercial lots. I am requesting that these documents be updated to reflect the current development proposal.
2. The applicant has provided 2 of 3 court decrees that have been issued for this property. Please have the applicant provide a copy of the decree/augmentation plan in 99CW065.
3. WSIS needs to be clarified. Primarily, it is unclear whether the info on page 2 reflects the estimated demand for the subdivision or the amounts decreed under the court decrees. It needs to be resubmitted, clearly providing the info requested on the form.

Entech has provided a thorough report concerning soil, geology, geologic hazards and wastewater suitability. Colorado Geological Survey (CGS) has no objection to the planned development provided all Entech’s recommendations are strictly adhered to.

The Plat states in General Note 12 that site specific soils and foundation investigations are required for each lot/foundation and that radon mitigation and building perimeter drains may be required. We agree that this note should be adhered to in this development.

This Replat supports Goal A.4.3. of the Trails Addendum to the Black Forest Preservation Plan, which encourages provision of neighborhood trails in new developments that can ultimately connect to the regional trail system. It has added an interior trail and a trail along a portion of the western perimeter, both of which are Actions proposed in Trails Addendum section A.4.3.c.

1. Enumerations will review the mylar prior to plat for address placement, street names and title block. **With RBD closure, Enumerations will review the mylar via pdf email. The proposed plat will be stamped. **

2. $10.00 per lot & tract platting fee will be due at the time of the review of the mylar (2 addresses per lot & tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. **With RBD closure, Enumerations will collect platting fees at a later date., fee to be collected is for 5 lots at $10.00 per lot. Colorado Division of Water Resources (CDWR) letter dated 3/21/18 indicates Applicant has application pending in Case No. 18CW3006 to change its augmentation plan. OCA research on the Court's website indicates a Decree was issued on 7/24/18 regarding the augmentation plan. The Lewis-Palmer Board of Education requests cash in-lieu-of land funds from El Paso County regarding this development.
In addition, the Board wishes to inform the El Paso County Planning Commission of the following:
Lewis-Palmer School District is nearing capacity at all schools in the district for grades K-8. The Ray Kilmer Elementary School, which will house the students from this development, is projected to exceed its program capacity in the new few years. Lewis-Palmer Middle School is currently at its program capacity.
The school district is in the process of planning additional schools. As you know, such planning will result in a ballot issue, which must pass to allow for relief. Whereas the Board of Education’s role is to ensure all students in Lewis-Palmer School District receive a quality education, we must advise the Planning Commission that continued housing growth without additional schools will ultimately impact the quality education Lewis-Palmer School District is known for.
The school district will remain in contact with land owners and consultants, as appropriate.

The Black Forest Land Use Committee recommends DENIAL of this request for several reasons.
1. This area is not designated as a commercial area in the Black Forest Preservation Plan.
2. The original plan kept the homes back away from SH 83 and kept a more open, rural design. To place lots of any kind much closer to SH 83 removes that desired design.
3. The Land Use Committee is opposed to further dividing lots after a subdivision has been approved. This would not be a good precedent to set.

Hi Nina,

An engineering geology map , Figure No. 2 is referenced in the Geologic Hazard Investigation done by RMG (no Date) for Dancing Wolf Estates. The figure is not included with the submitted report.

This is an important figure in that they show areas that are recommended to be avoided due to “Bog” conditions. We need to be able to compare this figure with the submitted development plan.

1. The final plat(s) must be approved and recorded prior to construction of any structure.
2. Prior to scheduling the item for hearing, all engineering documents must be signed by the County Engineer.
3. The HOA documents must be recorded prior to the final plat(s) and referenced on the face of the plat.
4. Prior to recording we will need the recording fee, tax valorem showing a zero balance, and title dated within 30 days. Additional documents to be recorded must also be submitted, such as the SIA. The Mylar will need to be signed by all parties other than El Paso County and have the PPRBD stamp placed on it. All recording fees are to be paid prior to recording.
5. Any items that are uploaded will override the previous versions and replace them.

By all appearances the Lot 3 DWE ROW is now intended to be a driveway for Lot 3 exclusively, instead of an extension of Dancing Wolf Way, with access to Lot 4 along the southern edge of the HOA Trail.

911 is fine with this arrangement, please let us know if we have misunderstood the intention here.
