Applicant - I reviewed the Covenants prepared based on sample language I had provided earlier this month. I have now revised the sample language to be specific. Attached is a revision plus 3 provisions that specifically need to be added: Amendments, Termination, and Enforcement. I am not making an opinion as to any other provisions in their Covenants; however, their Para. 17 re Signs may be problematic for the Declarant, but that is their issue.

I will want to see a revised version. I also want to see the form Special Warranty Deed that they will use to convey water to each lot owner. I want to review and approve both of these before the plat is recorded. Cole Emmons-County Attorney's Office 10/25/19

Floodplain has the following comments:

1. New FEMA FIRM panels recently became effective for El Paso County. The floodplain statement should be revised to show the new information: panel number 08041C0575G with an effective date of December 7, 2018. The LOMR information shown on the floodplain statement can be deleted as that information has been incorporated into the new mapping.

1. Per Regional Building Code, section RBC312.8 addresses must appear on plats. Submit a 100 scale copy of the plat to our office for addressing. Place an (xxxx) on all lots and tracts which will require an address, in the location the address will be needed. Once addressing is completed, the addresses will be returned so that they may be placed on the mylar prior to recording.
2. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. A fee of $10 per lot/tract addressed, payable to Pikes Peak Regional Building Department will be due at the time of mylar review.
3. Provide a copy of the final recorded plat to Enumerations. Approval of any plans submitted for this development will be pending receipt in our office of a copy of the final recorded plat.

Regarding a request for approval of a final plat for Judge Orr Ranchettes, Enumerations has the following comments:

1. Please clarify the extent of proposed Peppergrass Dr. The letter of intent states that this street will terminate in cul-de-sac bulbs north and south of the floodplain area, but the plan appears to indicate that it will be a continuous road. If it is not going to connect, then it should be 2 different street names.
2. Has the name Peppergrass Dr. been approved by Justin Annan at El Paso/Teller E911? An email from him showing that this road name has been approved is needed before Enumerations can approve any plats. Is this proposed street(s) public or private. If it is private, then the suffix Dr. should be replaced by Point, Grove, Heights, or View. Will the northern section of the proposed road be connected to Stapleton Dr. in the future?
3. Provide a copy of the proposed plat to Enumerations for addressing. Indicate with (xxxx) the locations of needed addresses. Per Regional Building Code section RBC312.8, addresses must appear on plats.
4. Prior to recording, Enumerations will review the mylar for addressing, street names, title block and floodplain statement. An Enumerations fee of $10 per lot/tract addressed will be due at that time. In this case, 7 lots x $10 per lot = $70
5. Provide a copy of the final recorded plat to Enumerations. Enumerations will not approve any building plans for this development without a copy of the final recorded plat in our records.



Floodplain has the following comments:

1. There is substantial floodplain area in this development. It appears that the proposed lots and easements comply with Regional Building Code section RBC313 (floodplain code). Contact Floodplain Administrator Keith Curtis (keith@pprbd.ord, 719-327-2898) with questions or concerns regarding compliance with floodplain code.

General
1. Should the request be approved additional fees will be required at the time of recording for the recording, park, school, drainage/bridge, etc. The applicant must also supply: zero tax certificate, title dated w/in 30 days, the Mylar with all signatures and certifications, and any other items necessary (SIA, collateral, etc).
2. All engineering documents must be approved prior to the item being scheduled for hearing.
3. Be aware that with the final plat you will need to submit the petition for inclusion into the PID to Lori Seago (attach the word version of the legal). There will be an additional fee to the Attorney office for the publication. A note will need to be placed on the plat outlining the inclusion within the PID. Prior to the plat being recorded, the plat will be presented to the assessor who will add the PID to the taxing entities.
4. Additional redlines and comments will be provided by engineering staff.
Notification
1. The adjacent property owner notification certified stubs do not indicate who the letters were mailed to. We have no way to verify the letters were mailed to the persons listed on the spreadsheet. Please provide certified stubs that are completely filled out with the names and addresses.
Application
1. Please revise zoning to A-35. The platting actions could only be approved if the rezone is approved.
USF&W
1. The letter submitted is not a clearance letter from the USF&W.
Letter of Intent
1. Revise to include specific citations from the small area plan and policy plan with an analysis of how those citations demonstrate consistency.

Peppergrass Drive – Conflicts with existing street “Peppergrass Lane” in Fountain.

In order to provide efficient routing for emergency services, it would be best to give these two streets unique names until the development has taken place to connect them.

To assist with the naming of the two streets, I have attached the street naming guide. Names can also be checked against the existing name database located at www.elpasoteller911.org/Services/Street-Emergency-Number-Databases
