Thank you. This Amendment supports Goal A.4.3. of the Trails Addendum to the Black Forest Preservation Plan, which encourages provision of neighborhood trails in new developments that can ultimately connect to the regional trail system. It has added an interior trail and a trail along a portion of the western perimeter, both of which are Actions proposed in Trails Addendum section A.4.3.c.

Given the listed permitted use on the Community Commercial sites, a traffic impact study is required with the resubmittal. The study will be based on the highest and best use.

The Black Forest Land Use Committee recommends DENIAL of this request for several reasons.
1. This area is not designated as a commercial area in the Black Forest Preservation Plan.
2. The original plan kept the homes back away from SH 83 and kept a more open, rural design. To place lots of any kind much closer to SH 83 removes that desired design.
3. The Land Use Committee is opposed to further dividing lots after a subdivision has been approved. This would not be a good precedent to set.

1. Please ensure that each proposed lot has an adequate buildable area.
3. Should the request be approved, final plat(s) will be required to create the proposed lots and vacate the ROW. The final plat(s) must be approved and recorded prior to construction of any structure.
4. Prior to scheduling the item for hearing, all engineering documents must be signed by the County Engineer.
6. Any soils mitigation measures required (ex: underdrains) should be identified as a note on the final plat.

The letter of intent doe snot include specific citations as to how/why the request is consistent with the small area plan and county policy plan. Please include specific citations with analysis. The PUD zoning requires a minimum of 10% open space. No designated open space was provided with the original request and no new open space is proposed with the amendment. It is stated that a trail easement will run alongside the flag stem and will connect to the Black Forest Trail along Hodgen Road via an added tail easement. It seems that the interior trails will be only for the DWF residents and guests and maintained by the HOA. However others can use the County Regional Trail System along Hodgen.
