Review 1 comments have been resolved. Engineering has no further comments regarding drainage or transportation. Any approved documents will be uploaded by the project manager.

Note:
Parcel does not have a driveway access permit on file for the existing driveway. A driveway access permit is required for all parcels with access points within unincorporated El Paso County and is a requirement for a building permit.

Please be aware:
- Per El Paso County Resolution 19-471 land use approvals generating new trips to a parcel shall pay Road Impact Fees. The proposed special use request, Kennel, falls under the "Office" land use for Road Impact Fees. The fee is $3,180 per 1,000 square feet. The Road Impact Fee will be assessed on the gross floor area of the structures being used for the special use.For further information please visit: https://publicworks.elpasoco.com/road-impact-fees/ .

- There is no Driveway Access Permit on file for existing driveway. A Driveway Access Permit is required for all access points onto a county or private road. Please apply for a driveway access permit through EDARP, https://epcdevplanreview.com/ . Under "Getting Started" click on "Initiate a minor application", select Access Permit, and enter a valid email address. A verification code will be sent to the email provided. The verification code will be needed to access the application online.
In the application, please select “Secondary Access” the application will be sent to the access permit administrator for triage. The permit fee will be waived as the residence was built prior to 1972.

The Upper Black Squirrel Creek Ground Water Management District offers the following comment regarding the Keila Johnson Kennel. The well permit associated with this property, permit number 82940, does not allow for commercial uses. The applicants will need to amend their permit through the Division of Water Resources to allow for a small capacity commercial well permit to be in compliance with their proposed kennel business.

Please refer to Upper Black Squirrel's Rules and Regulation under 3. SMALL CAPACITY WELLS, B(ii) 5), For wells proposed for commercial use pursuant to §37-90-105(C), C.R.S., withdrawals shall be limited to 1 acre-foot per year. You will also need to comply with C.R.S. 37-90-105 (C) rules below:

C.R.S. 37-90-105. Small capacity wells.
(II) To qualify as a “commercial business” under this paragraph (c), the business shall be:
(A) A business that will be operated by the well owner and that will have its own books, bank accounts, checking accounts, and separate tax returns;
(B) A business that will use water solely on the land indicated in the permit for the well and for the purposes stated in such permit;
(C) A business that will maintain its individual assets and will own or lease the property on which the well is to be located or where the business is operated;
(D) A business that will have its own contractual agreements for operation of the business;
(E) A business that agrees not to transfer a permit issued under this paragraph (c) to another entity that also holds a small capacity commercial well permit under this paragraph (c); and
(F) A business that agrees to notify any potential buyer that such buyer shall notify the state engineer of any change in ownership of such business within sixty days after any such change in ownership.
