Staff appreciates the update to the noise study. The noise study indicates that construction practices will reduce the interior noise from the adjacent roadways. The noise study does not acknowledge the Colorado Springs Airport Advisory Committees (CSAAC) request for a reduction in interior noise by construction practices; however, the study implies it. The letter of intent states the opposite that, NO noise mitigation is proposed. I recommend you revise the LOI to state that "...noise reduction mitigation via construction practices such as additional X,X,X (provide examples of the techniques: increased setbacks from Marksheffel at X, setbacks from Constitution Ave. at X, , insulation, 3 Payne glass etc). are proposed to be included into the development of the multi-family site. These construction mitigation techniques are also in response to the CSAAC request......"

Staff will proposes a condition of approval the subject property will require new noise study if the concurrent site development plan's multi-family building layout design is modified from what is currently depicted in the Noise study.

Colorado Geological Survey review of the resubmittal for Upland Flats By Watermark Filing 1 Final Plat SF2112 (Amy Crandall, P.E., acrandall@mines.edu):

The available referral documents include the preliminary geotechnical engineering study (Kumar & Associates, Inc., September 10, 2020). Per Appendix C of the El Paso County Engineering Criteria Manual and Section 8.4.9 of the El Paso County Land Development Code, a geologic hazard study should also be performed. The submitted preliminary geotechnical report does not discuss the site geology and does not directly discuss the potential geologic hazards associated with the site. However, the site does not contain steep slopes or flood hazards, nor is it exposed to any geologic hazards that preclude development. Kumar’s geotechnical recommendations appear appropriate to address the potential geologic constraints identified at this site, including expansive soils. If a geologic hazard report was performed at an earlier stage of the review process, we would appreciate a copy for our records.

Kumar has identified man-placed fill and expansive clay and claystone materials that impose geotechnical constraints on this site. Kumar recommends on page 23, “the expansive clays and claystone be overexcavated and replaced with a nonexpansive structural fill where present within 5 feet of the bottom of spread footing foundations, floor slabs and the pool.” For PT slab foundations, Kumar recommends a 4-foot overexcavation from the bottom of the lowest portion of the foundation element/rib. Provided Kumar’s recommendations regarding subgrade preparation, overexcavation of man-placed fill and expansive clay and claystone materials, structural fill and backfill placement, foundations, floor slabs, movement estimates, grading and surface drainage, and construction observations are strictly adhered to, CGS has no objection to approval. CGS recommends Kumar be retained to review the project plans and specifications for conformance with the recommendations provided in their report.

STANDARD FINAL PLAT COMMENTS:
Standard final plat comments still apply, but with RBD being closed, there are a few new changes to Enumerations review of the Mylar. Please, send a pdf of the final plat document (intended plat of record) to the Enumerations reviewer that reviewed the project. We will then check the mylar for the normal things we look at on a plat, address, street names, title block and floodplain statement. Then we will stamp off on that document with an RBD check stamp, if all is accurate. This will be our copy of record that we plan to see once the document is recorded, minus a few signatures on the main sheet. No addressing fee will be required due to the address already being assigned.

Mountain View Electric Association (MVEA) has existing facilities within this parcel of land. MVEA requests that all existing easements are included in the plat. The Association will serve this area according to our extension policy. Information concerning connection requirements, fees, and upgrades under the Association’s line extension policy can be obtained by contacting the Association’s Engineering Department.

MVEA also requests all open space, drainage, and landscape tracts designed in this subdivision be listed to include utility easements, along with a twenty (20) foot boundary utility easement on plat. Additional easements may be required once a review of civil drawings with grading and erosion plan is provided to MVEA in order to serve.

On page 12 of the Letter of Intent (Kimley-Horn & Associates, January 29, 2021), Kimley-Horn references a preliminary soils and geology report, “Preliminary soils and geology testing performed in support of the planned development provide recommendations that multi-unit buildings be constructed with shallow foundation systems with partial overexcavation of any underlying expansive materials.” Per El Paso County Land Development Code (8.4.9), “All sketch plans and preliminary plans submitted for review shall be accompanied by geology and soils report.” If available, CGS would appreciate a copy of the geology and soils report to review in conjunction with the proposed project.

The site does not contain steep slopes or flood hazards, nor is it exposed to any geologic hazards that would preclude the proposed nine-building multi-family development. Provided a geology and soils report is performed for this project and provided for our review during the site development plan submittal, CGS has no objection to approval.

I noticed that they are vacating easements. Does El Paso County allow vacations by plat? If vacations by plat are allowed then there are no action items and approval can be recommended. If it isn't allowed, then they will need to revise appropriately. Let me know if you'd like to discuss further.
