Please provide an updated preliminary plan as soon as possible so it can be attached to the November 2cd PC staff report. The Letter of intent is dated March 2021. The 3rd waiver regarding frontage is not necessary because private roads are requested (its inherent that all lots will not have frontage) per the Code:
(e)Minimum Frontage. Lots shall have a minimum of 30 feet of frontage on and have access from a public road, except where private roads are approved by the BoCC pursuant to waiver granted under Section 8.4.4 (E).

Please make updates to the LOI. Engineering comments will be posted shortly. Please work to address the engineering comments so item can stay on track for the back to back BOCC hearing November 9th.

FYI: The following are draft conditions of approval that are being considered for this project

"The final plat for Bent Grass East Commercial Filing 3 shall require fair and equitable contribution toward final construction, paving and associated repairs to Bent Grass Meadows Drive southwest of the site, including design and construction of an eastbound left turn lane on Woodmen Frontage Road at Bent Grass Meadows Drive, if not constructed or covered by financial assurances of others. These road improvements may be eligible for cost recovery from adjacent developers.

The Developer shall participate in a fair and equitable manner in offsite transportation improvements, including but not limited to the items listed in Table 4 of the Falcon Meadows at Bent Grass Transportation Impact Analysis, as amended and pending approval:
a. Lengthening of the current eastbound single left-turn deceleration lane on Woodmen approaching Golden Sage Road.
b. Southbound exclusive right-turn lane on Golden Sage Road approaching Woodmen Road.
c. Signalization of Golden Sage Road/Woodmen Frontage Road or reconstruction as a modern roundabout
The improvements and fair shares are to be verified with an updated traffic memorandum with the final plat for Bent Grass East Commercial Filing 3. An escrow agreement, including a financial assurance estimate for the intersection improvements, as approved by the Planning and Community Development Department Director and the County Attorney’s Office, shall be completed and escrow deposited with the final plat if these improvements have not been constructed or covered by financial assurances of others."

The MDDP was deferred from Bent Grass Meadows Fil 2 plat in an effort to assist in the ability of housing in the area, to the Falcon Meadows PUDSP and is under review. The intersection of Meridian and Bent Grass Meadows Drive is under construction for phase 1 with the platting of Bent Grass Meadows Fil 2 plat. The MDDP was deferred from Bent Grass Meadows Fil 2 plat in an effort to assist in the ability of housing in the area, to the Falcon Meadows PUDSP and is under review. 1. For assignment of addressing for lots and tracts, place addressing marker (xxx) where they are intended to be utilized. Addressing marker for lots should be front door.

2. Provide a 100 scale copy or larger of the entire APPROVED development to this department so that addressing can be assigned. Once received, the development plan will be placed on a list to be addressed.

The Bent Grass East Commercial Filing 3 site (38.949, -104.61) does not contain steep slopes or any identified geologic hazards or unusual geotechnical constraints that would preclude the proposed development of 6 commercial lots and 1 tract. The available referral documents include a Soil, Geology and Geologic Hazard Evaluation (Entech, Engineering, Inc., October 15, 2020) and Preliminary Subsurface Soil Investigation (Entech, Engineering, Inc., June 6, 2017). CGS concurs in general with their description of surface and subsurface conditions based on four borings, and laboratory testing. Entech makes appropriate recommendations regarding site development. Provided all Entech’s recommendations are strictly adhered to, CGS has no objection to approval of the preliminary plan. Specifically, Entech’s recommendations for shallow foundations with either subsurface perimeter drains or slabs above exterior grade should be required for this site to mitigate shallow groundwater.
As recommended by Entech, site specific investigation, testing and analysis will be required for designing foundations, floor systems, subsurface drainage, pavements, etc.
