County Attorney - Development Review
2/5/2020 12:11:18 PM
1. Most recent version of SIA is acceptable - no changes.
2. Most recent version of Detention Maintenance Agreement is acceptable - no changes, other than removing the Ex. A that is attached to the Agreement.
3. The separate Exhibit A to the Detention Maintenance Agreement is acceptable.
4. The separate Exhibit B to the Detention Maintenance Agreement should simply be a legal description of the tract upon which the stormwater improvements will be built, e.g. "Tract A, Midtown Collection at Hannah Ridge Filing No. 2."
5. Regarding the comments on the covenants related to inclusion of the provisions of the Detention Maintenance Agreement, I still do not find the necessary language. I have reached out directly to the attorney that drafted the covenants for resolution.

County Attorney - Development Review
1/14/2020 10:46:07 AM
I am in receipt of a petition to include this property in PID No. 2 for purposes of partial payment of the road impact fee.

State law requires that legal notice of the BoCC hearing to include the property in the PID be published. Developer is responsible for reimbursing the County Attorney's Office for the cost of publication.

The inclusion hearing must be held before the plat is recorded. The County Attorney's Office makes every attempt to schedule the inclusion hearing on the date of BoCC or administrative approval of the plat, or as close thereto as possible.

**The developer and County Planning are responsible to keep the County Attorney's Office informed of the anticipated plat approval date.**

Proposed changes to Detention Maintenance Agreement are attached.
With respect to the provisions of paragraph 8, I found no language in the Covenants specifically addressing the required items. Please amend the Covenants appropriately and resubmit or identify the provisions of the Covenants that meet these requirements.
Exhibit A must be amended. It should be a legal description of Filing No. 2.
Exhibit B must be amended. It should be a legal description, with a visual depiction if desired, of the tracts or easements upon which the stormwater facilities will be constructed.

The Plat review red line comments did not all get addressed; comments remain. The official name of the approval of the plat is now known as "Record of Administrative Determination" in lieu of the BOCC resolution or BoCC approval date in the signature block. 1/6/2020 1:45:47 PM
