When reviewing the site plan for this project, we discovered that setbacks labeled for the existing structure where the rodent farm use is proposed do not comply with the required setbacks for a livestock feed yard. The El Paso County Land Development Code (Table 5-4. Density and Dimensional Standards for Agricultural, Residential, and Special Purpose Districts, footnote 9) requires that livestock feed yard uses be setback a minimum of 200 feet from all property lines, except that loading facilities may be located adjacent to a road right-of-way where loading/unloading of animals takes place.

A Variance from the Board of Adjustment will be required to obtain approval for the structure to remain in it's current location (if the existing structure is proposed to house the livestock feed yard use.) The criteria that the Board of Adjustment will use to evaluate the variance request are specified in Land Development Code Section 5.5.2(B)(2)(a).

Additionally we cannot find records that the existing structure is a permitted structure.

If you do not want to seek variance for the existing structure, one alternative would be to relocate the structure to comply with the required 200 setbacks. I am not sure how difficult or feasible this is based on the construction of the building but you could potentially relocate and permit the structure at the same time.

We cannot proceed with the special use application until this issue is resolved because a site plan showing the location of the proposed livestock feed yard use in compliance with the required 200' setbacks is an application requirement that supports the special use. Additionally one of the approval criteria for the special use is "The special use conforms or will conform to all applicable County rules, regulations, or ordinances."

Please let us know how you would like to proceed. If you decide to seek variance we will need to set up another project in EDARP. The application fee for the BOA variance request is $1037.00.

1. The metal building was reviewed by Regional Building department for permit as residential use. It will need to be brought up to commercial use standards. Contact a construction plan reviewer Shelley, shelley@pprbd.org
