At their monthly meeting on April 8, 2019, the Lewis-Palmer School District Board of Education voted to request cash in-lieu-of land funding for homes permitted in this development. Additionally, the Board does wish to inform the El Paso County Planning Commission of the following:
"Lewis-Palmer School District is nearing capacity at all schools in the district for grades K-8. The Ray Kilmer Elementary School and the Lewis-Palmer Middle School, which will house the students from this development, are projected to be at or exceeding program capacity for the upcoming school year. The school district is in the process of planning additional schools. Such planning will result in a ballot issue, which must pass to allow for relief. Whereas the Board of Education’s role is to ensure all students in Lewis-Palmer School District receive a quality education, we must advise the Planning Commission that continued housing growth without additional schools will ultimately impact the quality education Lewis-Palmer School District is known for."

We feel that lot 4 should access the cul-de-sac on a flag and NOT access Hodgen Road directly. This is a busy road at a busy intersection and it is not safe to add a private driveway at this point on Hodgen.

Goal A.4.3.A. of the Trails Addendum to the Black Forest Preservation Plan is for provision of neighborhood trails in new developments that can ultimately connect to the regional trail system. The regional trail from Black Forest Regional Park is projected to reach Hodgen Rd. near High Plains and a planned bicycle route along Hodgen adjoins the subdivision. We suggest consideration of an internal trail along utility easements and/or through the No Build area for residents of the community to conveniently access these coming recreational amenities.

I see note 19 addresses our code requirement of for no build -
Buildable lots two
and one half (2½) acres and larger, are required to have the 100-year floodplain contained in a drainage easement dedicated by plat in the name of the governing body with the restrictions of “No Build” and “No Storage of any Materials”;
make sure the effective date gets added to note 19 prior to final plat.
Also as we discussed clarify the county prudent set back area. I would think the county would want a note added that describes the associated restrictions.

1. The fire protection report seems to be a draft and is missing information (dates as XX).
2. The letter of intent does not address all review criteria listed in Ch 8 of the Land Development Code. Please review and revise accordingly to address each specific criteria.
3. The title work indicates there are easements onsite that have not been shown on the preliminary plan.
4. A wildland fire report was not submitted.
5. The SIA signature block should be revised for the current BoCC President. See additional comments by County Attorney.
6. The subdivision summary acreage does not add up to 39.4 acres.
7. The final plat cannot be recorded until/unless the LOMR is approved. Without the LOMR being approved there is no guarantee that the floodplain is properly shown.
8. The assessor does not show the property is within a fire district. Please submit proof of annexation into the District.
9. Additional redlines will be provided upon completion of the PCD engineering division.
General
5. Please add the file number SF-18-024 to add drawings and reports.
6. The final plat(s) must be approved and recorded prior to construction of any structure.
7. Prior to scheduling the item for hearing, all engineering documents must be signed by the County Engineer.
8. The HOA documents must be recorded prior to the final plat(s) and referenced on the face of the plat.
9. Prior to recording we will need the recording fee, tax valorem showing a zero balance, and title dated within 30 days. Additional documents to be recorded must also be submitted, such as the SIA. The Mylar will need to be signed by all parties other than El Paso County and have the PPRBD stamp placed on it. All recording fees are to be paid prior to recording.
10. Any items that are uploaded will override the previous versions and replace them.

Black Forest Land Use Committee

The Black Forest Land Use Committee commends the applicant for following the Black Forest Preservation Plan in this proposal. Having a development that averages 5 acres or more per lot is totally in keeping with the Preservation Plan.

The Land Use Committee is concerned with having a driveway on to Hodgen Road for lot 4. At that point, Black Forest Road intersects Hodgen from the south and traffic is heavy in several directions. We recommend that the applicant design a flag off the cul-de-sac on Raleigh Rd to go into lot 4. We realize this will probably require a culvert crossing the drainage area but feel this is better and safer than a direct access on to Hodgen.

Lands within the 100 year floodplain shall be established in a tract. Consult with the Floodplain Administrator once the LOMR is complete for further direction on requirements for subdivision. A floodplain statement is required on the final plat. To include the LOMR case number with effective date.
